JAMMU, Sept 27: Amidst delaying tactics by J&K Administration, the National Human Rights Commission (NHRC) has again directed the Union Territory Administration to pay monetary compensation to the next of kin of infants/children who allegedly died due to consumption of a particular spurious cough syrup in Ramnagar Tehsil of Udhampur District of Jammu and Kashmir during the month of December 2019 -January 2020, within eight weeks.
The NHRC vide its recent proceeding dated September 21, 2021 in Case No.80/09/14/2020 has asked the Chief Secretary, UT of Jammu & Kashmir to submit any additional/final report of the proof of payment of aforesaid amount of Rs 3 lakh to NoK of each deceased infant/child by November 26 to the Commission.
The UT Administration has told the Commission that the proposal of the payment of compensation is under active consideration in the General Administration Department (GAD) for placing it before the Administrative Council for consideration and approval.
Interestingly, while on the one hand, the UT Administration has been trying to portray that it was willing to pay compensation to the victims, on the other hand, it has even filed a Special Leave Petition (SLP) in the Supreme Court against the order of the J&K High Court which has not only rejected the plea of the administration against the payment of compensation but also passed strictures against the conduct of the bureaucracy. However, the UT Administration is trying to delay the matter by pleading approval by the Administrative Council headed by Lt Governor Manoj Sinha and also subject to the outcome of the SLP pending before the Supreme Court of India, the Apex Court of the country.
The issue of deaths of infants was taken up by Sukesh C Khajuria, a social activist, with the NHRC seeking compensation for the families of the victims and fixing of the responsibility of the concerned authorities.
Khajuria said that the delay on the part of UT Administration has been callously criminal. He said that the claims of the Union government as well as the UT Administration of being guardian of people's right stand negated due to the ground realities in the case. He further said that the duplicity of the character of the bureaucracy of the Administration has been heart breaking for the poor victims. He urged the NHRC to not give any further time to the bureaucracy and act if they fail to pay compensation within eight weeks.
It is pertinent to mention here that the NHRC had asked the Chief Secretary, Govt. of Jammu & Kashmir to pay monetary compensation of Rs 3, 00,000 to the NoK of each deceased on 18-01-2021.
