Court awards six months imprisonment, fine of 40 lakhs in cheque bounce case | | | Early Times Report
JAMMU, Nov 29: Special Municipal Mobile Magistrate Jammu, Parveen Pandoh today awarded six months imprisonment and fine of 40 lakhs on Ranjeet Kour in cheque bounce case. The Special Municipal Magistrate Jammu after hearing both the sides observed that the accused has failed to raise probable defence which creates doubt about the existence of legal enforceable debt or liability. The issuance of cheques, dishonour of the cheques and non-payment of money by the accused within 15 days from the receipt of demand notice has been proved but the accused could not raise a probable defence about the non-existence of legally enforceable debt or that the liability stands discharged as alleged and ordered that Ranjeet is sentenced to undergo simple imprisonment for six months and a fine of Rs. 40 lakhs along with 6 percent simple interest from the date of cheque till the date of this judgment. The fine shall be paid to legal heirs of complainant as compensation. The court directed that accused to undergo simple imprisonment of two months in default of payment of fine.
