Court grants interim bail to JE caught by CBI in graft case

JAMMU, Dec 6: Special Judge Anti-Corruption (CBI cases) Justice Sanjeev Gupta has granted interim bail to junior engineer Sanjay Koul who was caught red-handed by the CBI while accepting a bribe of three lakhs.
The case was registered on the basis of a complaint made on 29-11-2021 by one Mohammad Adiem Parihar alleging demand of bribe of three lakhs at the hands of accused Hilal Ahmad Sheikh, serving as Superintendent Engineer, PWD (R&B), Circle Udhampur-Reasi for processing the file related to technical sanction of the project awarded to the complainant through tender for construction of medical sub-centre in Reasi district in 2017-2018, of which complainant had executed some part of project.
However, during negotiation the accused agreed to accept 1.50 lakhs as bribe to be paid to his technical officer and the remaining amount be paid later on after receipt of bill amount. The complainant told the accused that he cannot arrange the remaining amount in cash and stated that some cash and remaining amount by cheque will be arranged.
Reportedly CBI laid trap at PWD guest house at Udhampur on 2-12-2021 and graft amount of Rs. 40,000 in cash and a cheque of Rs. 1, 10,000, lying in an envelope kept in a bag by the petitioner was recovered which was accepted by him from the complainant on behalf of accused on the instructions of accused Predhimen Krishan Koul. The petitioner was arrested on spot on 2-12-2021 was remanded to custody by CBI for custodial interrogation. Presently, petitioner is on judicial remand.
The Special Judge Anti-Corruption observed that keeping in view the medical issues related to the petitioner pointed above, but without commenting on merit of the matter of the matter, of the considered opinion that petitioner has made out a case at this stage for grant of interim bail in his favour. The petition is accordingly allowed and the petitioner is admitted to interim bail who shall be released from custody on furnishing surety and personal bonds in an amount of Rs. 50,000 each, subject to conditions that the petitioner shall report to investigating officer for being further associated with investigation as and when required, the petitioner shall not try to influence the prosecution witnesses and the petitioner shall not leave the jurisdiction of this court without prior permission from IO.
