NIA Court frames charges against two PoK LeT militants

JAMMU, Jan 3: Special Judge NIA Sunit Gupta has framed charges against two POK LeT militants Khalil Ahmed Kayani and Mohammad Nazeem under sections 13/18/23/39 of UA(P) Act , 7/25 Arms Act and 3/3A of EIMCO.
The NIA case said that on August 21, 2019 troops of Himmat battalion deployed in Gulmarg sector were tasked to carry out area domination along the Line of Actual control. During the task, they noticed two Pakistani nationals moving suspiciously near Nilkanth Nallah about 700 meters towards the Indian side of LoC. Both the said persons were apprehended by the troops.
The arrested disclosed that they belong to Lashkar-e-Taiba ( LeT) and they had crossed the LoC with the support of Pakistan army/ISI. They had dropped the weapons at a place in forest area. After the search of the area by the troops, some arms, ammunitions pouches, medicines and eatable items were recovered. They revealed that they had kept some war like stores along with Nilkanth Nallah. The area was searched by the troops and 12 grenades, IED material including explosives and detonators were recovered.
On the basis of the complaint FIR 10/2019 under sections 7/25 Arms Act, sections 13/15/18/20 of UA(P) Act was registered with P/S Gulmarg District Braramulla. The arrest memos of both the persons were prepared who disclosed their names and particulars as Khalil Ahmed Kayani S/O Abdul Aziz Kayani R/O Tedaban Khurshidabad District Haveli Forward Kahuta (PoK) and Mohammad Nazeem S/O Mohd Arif Khan R/O vill. Tedaban Khurshidabad District Haveli Forwad Kahuta (PoK).
The arms and ammunitions recovered were one AK-47 Rifle, one Pistol, one magazine of pistol, six cartridges of pistol, three magazines of AK-47 Rifle, 120 rounds of AK-47 Rifle and two pouches.
Subsequently, in compliance to the order No. 11011/48/2019 dated 20th Sept. 2019 issued by Ministry of Home Affairs, Govt. of India, this case was assigned to national Investigating Agency and after taking up the case by NIA , it was re-registered as RC-05/2019/NIA/JMU dated 23rd Sept 2019.
During the investigation by NIA, it was revealed that both the accused persons were in contact of handlers of LeT namely Nadeem based at Kacharban (PoK) and the Pakistani army personnel deployed at a Pakistani army post, old Batalan, District Haveli Forwad Kahuta (PoK). The investigation further established that the accused persons used to cross the LoC and enter in the forest area of Kashmir with intention to do recee regarding the movement of Indian Army personnel and to know about the explosive mines set up by the Indian Army near LoC , as per the directions of the Pakistani army for making infiltration of the terrorists of LeT in Kashmir.
The Special Judge NIA J&K observed that the offences under sections 13/18/20/23/39 of UA(P) Act are concerned, it is prima facie proved that the accused persons were assigned with the job by PAK handlers of LeT and Pakistani army to conceal the arms, ammunitions and explosives at the pre-decided places across the LoC in the forest area of Indian territory for the use of Pakistani terrorist of LeT who were ready to infiltrate in the Indian territory by crossing the LoC with the help of Pakistani army to carry out the terror acts in the Kashmir. In this respect, the accused persons had cross the LoC and concealed the arms and ammunition and other articles at the pre decided placed in the forest of Indian Territory which were subsequently recovered by the Indian army at the instance of the accused persons.
The charges were read over and explained to the accused person through virtual mode who denied the same and claimed to be tried. The charge forms were forwarded to the Central Jail Kot Bhalwal, Jammu for obtaining the signatures of the accused persons. The same has been received back with the signatures of the accused persons and which were found attested by Superintendent Central Jail Kot Bhalwal, Jammu.
