HC upholds detention of sympathizer of militants | | | Early Times Report JAMMU, Mar 31: Justice Sanjay Dhar of Jammu & Kashmir and Ladakh High Court Srinagar Wing has upheld the PSA of Mohammad Rafiq Nazar who is sympathizer of militants and provides the food and shelter to them. Justice Dhar after hearing both the sides observed that a perusal of the grounds of detention, particularly para 3 thereof, reveals that there is an allegation that the petitioner is providing food and logistic support to the militants of banned organization JeM especially Mufti Altaf of Nethipora Dooru and that he is providing food and shelter to the militants and is also assisting in transportation of weapons. The identity of the militant to whom the petitioner is alleged to have provided food, shelter and logistic support for transportation of weapons etc. is clearly mentioned in the grounds of detention. Therefore, it is not a case where the necessary particulars required for making an effective representation against the detention order are lacking in the grounds of detention. Justice Dhar while dismissing the petition observed that the detention record that has been produced by counsel for the respondents for perusal of the court reveals that the petitioner has been provided with 10 leaves. The execution report bears the signature of the petitioner as also the signature of the executing officer. The material forming the basis of the impugned order of detention includes the grounds of detention and the police dossier. Besides this, the other documents which are available in the detention record include the impugned order of detention and notice of detention. |
