YouTuber granted bail in mock video of Nupur Sharma case | | | Early Times Report SRINAGAR, June 20: A Srinagar Court has granted bail to Kashmir based YouTuber Faisal Wani who uploaded a mock video where he enacted the beheading of suspended BJP spokesperson Nupur Sharma, here on Monday. The Court of City Judge Judicial Magistrate 1st Class, Srinagar observed that the offences against the accused do not carry severe punishment under law and refusal of bail in such a case would be unjust. “The accused has been in police custody for last 7 days. The offences in question are not very severely punished under law. Thus, there is no reasonable possibility of the accused fleeing the course of justice. The accused does not (have) any criminal antecedents.” No useful purpose would be served by the further detention of the accused person in any sort of custody. The refusal of the bail in such case would be unjust," the order announced on Saturday read. After hearing the arguments of the counsel and prosecution in the case, the Court directed the police to release the accused on bail provided he furnishes a personal bond of Rs 20,000 and one surety of the same amount. YouTuber Wani was arrested on June 11, in Srinagar for uploading a mock video where he is enacting the beheading of Nupur Sharma after her ?blasphemous? remarks on Prophet. The arrest came hours after he deleted the video on his You-tube channel and issued an apology. J&K Police took cognizance of the video and registered an FIR in Srinagar's Safa Kadal Police Station under section 505 (2) (statements creating or promoting enmity between classes) and 506 (criminal intimidation) of Indian Penal Code against the YouTuber. Wani had issued an apology after his video had gone viral, claiming he had no intention to hurt anybody. "I am extremely sorry if I have hurt somebody,” he had said in a hand-folded apology. |
