Jammu, Oct 8: Chief Judicial Magistrate Jammu Amarjeet Singh Langeh today directed Deputy Commissioner Jammu of to attach the movable property of the former MLA Radhey Sham Sharma. The CJM while directing the DC Jammu to attach the movable property of ex-MLA, observed that respondent, an ex-MLA and proprietor of Ms. Shanker Ice Factory & Cold storage Canal Road, Talab Tillo, Jammu – owed a liability of Rs. 11,12,000/- to petitioners in terms of settlement deed dated 25/04/2016 following which this execution petition was presented in this court under section 15(5) of Payment of Wages Act by Assistant Labour Commissioner, Jammu, who is authority under the said Act – for realisation of aforesaid amount from respondent proprietor for disbursements of the same to petitioners. In between, respondent proprietor made some payment and in terms of order dated 28/07/2022, the remaining amount payable by respondent Radhey Sham Sharma in the execution in hand is Rs. 4,62,000/. The Court further observed that the dilly dallying and recalcitrant disposition of respondent proprietor in making aforesaid payment is only driving petitioners to great deal of hardship for over five years now. He cannot play along like this, I say no more, the Court said. The Court issued fresh attachment warrant against respondent proprietor, authorising therein District Collector (Deputy Commissioner), Jammu to attach moveable property of respondent proprietor to the tune of Rs. 4,62,000 and submit compliance report by or before next date of hearing. It however is clarified that should respondent proprietor deposit an amount of Rs. 4,62,000/during execution of attachment warrant in question, in that eventuality District Collector (Deputy Commissioner), Jammu shall cause that amount to be received and deposit it in this court for onward disbursement to petitioners. The Court further issued non-bailable warrant of arrest against respondent proprietor to be executed by SHO Police Station Gandhi Nagar, Jammu in case attachment warrant aforesaid remains un-executed.
