Undertrial's family awarded Rs 5 lakh compensation by High Court | | | Early Times Report JAMMU, June 17: The Jammu & Kashmir and Ladakh High Court has ordered the government to pay Rs. 5 lakh as compensation to the family of an undertrial who was murdered by a fellow inmate nearly a decade ago inside Central Jail Srinagar. Justice Sanjay Dhar expressed strong criticism towards the authorities for their negligence in managing the jail facilities, which allowed the incident to occur. The court emphasized that the deteriorating conditions and the ease with which a co-prisoner obtained a weapon from the jail walls demonstrated the authorities' clear negligence and callousness. Highlighting the failure of the jail authorities to ensure the safety and security of the undertrial prisoner, Justice Sanjay Dhar stated that they cannot evade responsibility for the custodial death. The court stressed that despite the undertrial's status as a murder suspect, the authorities were still obligated to guarantee his safety. The court acknowledged that the deceased was unlawfully deprived of his life while in jail, thereby violating his constitutional rights. Justice Sanjay Dhar further recognized the emotional and practical repercussions of the untimely death on the deceased's widow, sons, and daughters, and deemed them entitled to compensation. After considering the deceased's age, the court ordered the government to pay Rs. 5 lakh in compensation to the widow and children within three months. This decision aimed to address the injustice caused by the authorities' negligence and the subsequent loss suffered by the family. |
