Court sentences Pak man in ‘Foreigners Act Case’ | | | Early Times Report
Jammu, June 17: Munsiff Bishnah Assma Choudhary has sentenced Mohd Shabaz, son of Noor Hussain, a resident of village Kotli Farid, tehsil Daska, District Sailkot, Pakistan, to 2 years of rigorous imprisonment and a fine of Rs. 10,000 in a case under section 14A of the Foreigners Act. After considering the arguments from both sides, the court found the accused guilty of violating section 14A of the Foreigners Act, 1946, on June 12, 2023. During the sentencing phase, the Assistant Public Prosecutor (APP) argued for the maximum punishment based on the facts of the case. On the other hand, the accused stated in his written submission that he had unintentionally crossed the Indo-Pakistan border while fishing near the border canal. He claimed that he had been attacked by wild bears and sought refuge near an Indian army post. The army personnel present at the post fired at the bears, causing them to retreat. The accused was then instructed to stop near the gate, where the army personnel searched him, placed him in a vehicle, and took him to a safe room. The accused, who described himself as a poor person and a painter by profession, requested leniency. The court ordered that after completing the imprisonment period, the accused should be deported to Pakistan. The Deputy Commissioner/District Magistrate, Jammu, and the In-charge Superintendent of District Jail Amphalla were directed to initiate the necessary procedures for the accused’s deportation to Pakistan in accordance with the law. |
