JKSAC urges LG Sinha for Legal Rights to DPs of 1947 from POJK | | | Early Times Report JAMMU, June 20: Jammu Kashmir Sharnarthi Action Committee (JKSAC) urges Lt. Governor Sinha to expedite legal rights for DPs of 1947 from POJK. The Jammu Kashmir Sharnarthi Action Committee (JKSAC) has requested Manoj K. Sinha, Honorable Lt. Governor of the Union Territory of Jammu and Kashmir, to advise the Principal Secretary of Revenue to initiate the process of issuing a notification to grant legal rights to the Displaced Persons (DPs) of 1947 from Pakistan Occupied Jammu and Kashmir (POJK). This notification would pertain to the plots and lands beneath their dwellings in various authorized colonies across the Jammu region. The announcement regarding this was made by Sh. Manoj K. Sinha on 9th October 2022 and 6th March 2023 during the inauguration of the LG Governance Camp at Bhour Camp, Jammu. During a meeting held in village Rohi, Jammu, Gurdev Singh, President of JKSAC, expressed his frustration and condemned the government for the delay in issuing the notification, despite the passage of nine months since the announcement by the Lt. Governor. He highlighted that even the Revenue administration claimed to be unaware of any directions regarding the issuance of such a notification. Gurdev Singh criticized the government for making hollow promises without taking concrete steps to fulfill them, and emphasized that mere slogans would not serve any purpose. Gurdev Singh informed the meeting participants that JKSAC has been consistently raising this issue with the government and its administration for several years, advocating for individual land mutation rights under the dwellings of the DPs. He questioned why the small pieces of land under their houses, having the same status, have not been regularized or mutated in their names, despite legal rights being granted to DPs over their allotted Evacuee and State lands under Section 3-A and 254-C of the 1965 Act. He expressed disappointment that the issue has been left unresolved, with only empty promises made for political considerations. He further explained that after the displacement camps, the DPs were resettled in different locations across the Jammu region on evacuee lands as well as state lands. Over time, through their hard work, they constructed permanent houses on these lands. However, the absence of legal rights over the land beneath their dwellings has caused significant difficulties for the DPs. They are unable to mortgage their lands/houses to obtain loans from financial institutions as per their needs. Gurdev Singh highlighted that although the issue was raised with the Divisional Commissioner multiple times and orders were issued to regularize these lands under Section 3-A and 254-C of the Agrarian Reform Act 1976, the Revenue authorities have failed to implement them. The matter was also brought to the attention of Lt. Governor Manoj K. Sinha in December 2020, who advised the Revenue Secretary to process the issue and issue the necessary orders or amendments. Unfortunately, no progress has been made, and the file keeps getting shuffled from one table to another. Gurdev Singh expressed hope that the government would prioritize the issue and issue the notification to regularize the land beneath the DPs' dwellings, especially in light of recent announcements granting legal rights to landless individuals and others under the PM Awas Yojna. Colonel M.K. Sharma, Dwarka Nath Khajuria, Tarlok Singh Tara, Meetu Kumari, Pooja Sharma, Pawan Sharma, and Rajesh Khajuria were among the prominent DPs who also shared their concerns during the meeting. |
