ED gets Lal Singh's 7-day remand

JAMMU, Nov 8: Special Judge CBI Jammu Bala Joyti today granted seven days remand former Minister and Dogra Swabhiman Sangathan Party (DSSP) supremo Lal Singh in Money Laundering case.
The court after hearing Special PP Ashwani Khajuria for the Enforcement Directorate, observed that Accused Chaudhary Lal Singh (aged 64 years) s/o Saran Singh, R/o H.No. 01, Ward No. 02, Kathua (UT of J&K) has been produced before me today on 08.11.2023 at 15:20 hours under proper custody by IO Shri Pardeep, Assistant Director, Directorate of Enforcement, Jammu. IO has prayed for ED remand of accused for a period of 14 days.
Perusal of the application and CD File reveals that accused was arrested on 07.11.2023 in case FIR No. RC0042020A0005 dated 12.09.2020 and ECIR bearing No. ECIR/JMSZO/04/2022 dated 31.03.2022 for offence under section 5(1 )(d) read with section 5(2) of J&K PC Act, Samvat 2006 (Pari Materia to sections 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988) and section 120-B of the Ranbir Penal Code 1989 (Pari Materia to section 120-B of Indian Penal Code, 1860). As per the Medical Certificate, accused is physically fit.
Rajesh Kotwal, Ld. Senior Advocate has registered his objections for grant of remand at this stage on account of ill-health of the accused as well as scheduled offences as alleged cannot be applied against me retrospectively. Besides, he has placed on record photocopies of medical records. Perused.
Since accused was arrested on 07.11.2023 and investigation of the case is at initial stage, besides accused is involved in a serious and non-bailable offence, he is remanded to ED (Directorate of Enforcement) custody for a period of 07 days w.e.f. 08.11.2023 to 14.11.2023. Accused has complained about his physical discomfort and requested for his proper medical checkup. He shall be subjected to regular medical examination under rules. He has been apprised of his right to engage an Advocate. Accused shall be produced in the Court by the IO after expiry of the ED custody remand period i.e. on 14.11.2023.
Meanwhile Choudhary Lal Singh today filed bail application in the Court of Principal Sessions Judge Jammu.
Principal Sessions Judge Jammu Sanjay Parihar directed ED to file report on November 10, 2023. —JNF
