Early Times Report JAMMU, Jan 18: In a pivotal judgment, 1st Additional District Judge Jammu, Virinder Singh Bhou, has ruled that the ad-hoc committee overseeing fencing activities in the Union Territory of Jammu and Kashmir cannot be restrained. The judgment, issued on January 15, came in response to a case filed by the Jammu and Kashmir Amateur Fencing Association (JKAFA) against the Fencing Association of India (FAI) and others. The legal dispute revolved around the legitimacy of the election conducted on May 6, 2023, the constitution of the JKAFA, and its registration with the Fencing Association of India. The court observed that these issues needed resolution before any confirmation of an interim injunction dated October 13, 2023, could be considered. The judgment highlighted that the ad-hoc committee, valid until March 31, 2024, could not be restrained from carrying out fencing activities in the Union Territory. The court emphasized the importance of not jeopardizing the future and career of players during the pendency of these issues. The ruling stated, "the adhoc committee which is valid till 31.03.2024 cannot be restrained from carrying out the fencing activity in the UT of Jammu and Kashmir because the future and career of the players cannot be jeopardized till then." The court found the application filed by JKAFA devoid of merits and dismissed it, ordering the vacation of the interim injunction dated October 13, 2023. The observations made in the judgment were clarified to be limited to the disposal of the application and not as an expression of opinion on the merits of the main suit. The decision ensures the continuity of fencing activities in Jammu and Kashmir, prioritizing the interests of the players involved. |
