Jammu, Jan 18: In a much publicized Airforce Killing case, today one eye-witness namely namely R. Rajeshwar Singh who made statement before Court said that he saw only Yasin Malik who fired upon them and when CBI counsel asked him that can he identify the other accused then he stated that he didn't know other as he was injured in the firing.
Yasin Malik who appeared before Court through virtual mode who denied to cross questions over the witness statement and stated that he would only represent his case by physical appearance.
The other accused who were present are Showqat Ahmed bakshi S/O Gh. Mohd Bakhshi resident of Bamina, Srinagar , Manzoor Ahmed sofi S/O Mohd Abdullah sofi resident of koker bazar,Lal chowk, Srinagar, Ali Mohammad Mir S/O Abdul Rehman Mir Resident Of Watergam Srinagar and Javaid Ahmed Mir S/O Ghulam Nabi Mir R/O Zainakaddal Srinagar.
Presiding Officer TADA Court Jatinder Singh Jamwal after hearing both the sides fixed February 15 and 16, 2024 as next date of hearing.
The facts of the prosecution case as emerged after investigation by the CBI are that the accused- Shoukat Ahmed Bakshi, twice visited Pakistan firstly in the month of April/ May,1989 and secondly in the month of Sep./Oct.1989 and met with the accused – Aman -Ullah Khan and hatched criminal conspiracy to attack the security forces including Air force officials, stationed at Srinagar, in order to create terror among them & in the mind of general public and to destabilize the Govt of India, established by law.
On his return back, he further entered into criminal conspiracy with accused- Yasin Malik, Javed Ahmed Mir alias Nalka, Mushtaq Ahmed Lone, Nana Ji alias Saleem, Mohd Rafiq Dar alias Ghulam Hassan, Manzoor Ahmed Sofi alias Mushtafa, Javed Ahmed Zarger & other accused of the case for executing the task assigned to him by the accused – Aman Ullah Khan.
In order to accomplish the afore delineated nefarious object and designs, accused- Dr Ghulam Qadir Sofi provided his residential accommodation situated at Hakam Bagh Rawal Pora to be used as a hide out for making plan and preparation by the afore named accused persons and for keeping the illegal arms and ammunitions, therein. Simultaneously, they procured a blue colored Maruti Car having No. JK E- 3575 from the accused – Ali Mohd Mir. It is further stand incorporated in the charge sheet of the CBI that on 25.01.1990 at around 7.30 AM, accused- Yasin Malik, & Javed Ahmed Mir alias Nalka , each armed himself with Klasnikov Rifles, boarded as a pillion riders on the motorcycle having No. JK D-3705, being driven by the accused- Mushtaq Ahmed Lone, who was armed with .30- bore pistol & proceeded from the afore mentioned hide out towards the pick up points of Air Force personnels, located at near and around Rawal Pora. Simultaneously, other group consisting of accused – Nana Ji alias Saleem , Manzoor Ahmed Sofi alias Mushtafa , Shoukat Ahmed Bakshi & Mohd Rafiq Dar alias Ghulam Hassan left from the afore mentioned hide out towards the assigned destination in the maruti Car having Reg No JK E 3575 being driven by the accused- Javed Ahmed Zarger. It is further in the CBI charge sheet that at that time , accused Nana Ji alias Saleem and Manzoor Ahmed Sofi alias Mushtafa were armed with Klashnikov rifles of 7.62 mm, bore , whereas, the accused – Shoukat Ahmed Bakshi , Mohd Rafiq Dar alias Ghulam Hassan & Javed Ahmed Zarger were having .30 bore pistol with each of
R. Rajeshwar Singh said that he saw only Yasin Malik who fired upon them.
Singh stated that he didn’t know the other accused as he was injured in the firing.

On reaching the fixed point, accused- Nana Ji alias Saleem and Manzoor Ahmed Sofi alias Mushtafa took their position behind the Oil Tankers parked near the Dustbin lying near the circle by the side of the triangle on the Sannat Nagar Road, whereas, accused- Shoukat Ahmed Bakshi, Mohd Rafiq Dar and Javed Ahmed Zarger took their position in front of a street of Housing Colony ,Rawal Pora. However, the engine of the car was kept in starting position, in order to facilitate the escape after commission of the crime. It is further referred in the charge sheet of the CBI that in pursuance of the earlier hatched criminal conspiracy accused -Yasin Malik and Javed Ahmed Mir alias Nalka, after deboarding the motorcycle - walked towards Air Men pick up point situated in front of M/S Tantray Gen Stores and immediately after reaching there, they started firing shots from the Klasnikov Rifles, being held by them upon the seven Air Force officials namely -ML Nathian Cpl- U S Rajwar, Cpl SC Gupta, VK Sharma, LAC A. Ahmed. Cpl V.U.Shekher and Cpl B.S Dhoni, causing them serious bullet injuries, out of them three Air Men namely A. Ahmed, V.U Shekher & B.S. Dhone succumbed to their injuries. Simultaneously, another group namely Nana Ji alias Saleem, Manzoor Ahmed Sofi alias Mushtafa who had taken their position behind oil Tankers opened indiscriminate fire shots upon a group of 10/15 Air Force officials standing at triangle on Sannat Nagar- Rawal Pora Road, causing serious bullet injuries to three of them namely- R.C Joshi, P.K Mishra & Smt Sheela Shrivashtaba ,who was proceeding on leave with her husband H.C. Shrivashtaba. As a result of indiscriminate firing by the afore referred accused, Air Force personnels started running, here & there. At the same time, accused Yasin Malik made a indiscriminate fire shots upon these running air force personnels. At this, he changed the emptied-magazine with the new loaded magazine of his Klashnikov Rifle near the dustbin point- Sannat Nagar and while, proceeding towards the Bye pass road, on the motorcycle as pillion rider being driven by the accused- Mushtaq Ahmed Lone, on seeing a Air Force official walking towards Rawal Pora circle made seven fire shots upon him, with the result , he got serious bullet injuries on his legs . Thereafter, after driving the motorcycle ahead, they found two more Air Force officers in winter Uniform namely B R Sharma & R.K Khanna. At this, the motorcycle stopped in front of them and at the same time accused -Yasin Malik got down from the motorcycle and fired upon these two Air force officers, with his Klashnikov Rifle. With the result, they both suffered grievous injuries, one of them namely- R.K Khanna succumbed to this injuries on spot. In the meanwhile, another group consisting of accused- Shoukat Ahmed Bakshi, Mohd Rafiq Dar and Javed Ahmed Zarger who have earlier taken position in front of a street of Housing Colony Rawal Pora, with the Klashnikov rifles, being carried by them, upon Air Force official namely- N K Rath, who, however, remained escaped unhurt,whereas, another Air force official namely Mohd Saleem received bullet injury on his ankle. Thereafter, all the afore referred accused boarded back the Maruti Car and the accused – Javed Ahmed Zarger drove the same towards Bye pass Road. On seeing the accused – Yasin Malik & Mushtaq Ahmed Lone, on the motorcycle afore mentioned accused -boarding the Maruti Car stop for a while on the Bye pass road.
