Special Judge CBI Bala Jyoti sentences Rly official to 5-yr imprisonment, Rs 25000 fine | Bribery Case | | Early Times Report
Jammu, Mar 13: Special Judge Anti Corruption and CBI cases Bala Jyoti on Wednesday sentenced a Railway official for 5-years imprisonment and Rs 25000 fine for taking a bribe 10 years ago. Tilak Raj, then Head Goods Clerk who was arrested red handed while taking a bribe of Rs 20,000 for reducing the penalty charges, levied due to delay in lifting the consignment from the Jammu Railway Station. The CBI had booked Raj and his colleague Kameshwar Singh, both then Head Goods Clerk, of Goods Office, Northern Railway, Railway Station, Jammu, for demanding bribe of Rs 22,000 from the complainant. In the trap operation, Tilak Raj was caught accepting Rs 20,000 from the complainant, which he shared with other two accused persons as well. The trap team arrested all the three accused, who were charge sheeted next year. “During trial, two accused persons namely Tarsem Lal and Kameshwar Singh expired, hence the trial against them was abated.” While pronouncing the quantum of punishment Special Judge Anti Corruption and CBI cases Bala Jyoti observed: “It is apt to note that the accused in fact is caught for the first time for such type of offences. He faced trial for more than 10 years. As such, taking into consideration, gravity of offence and overall facts and circumstances as discussed hereinabove the accused person is therefore convicted and sentenced as:- (i) Under section 120-B RPC, he is convicted and sentenced to undergo rigorous imprisonment of 3 years along with fine of Rs.5000/- and in default of payment of fine he shall further undergo simple imprisonment for 3 months. (ii) Under section 161 RPC, he is convicted and sentenced to undergo rigorous imprisonment of 5 years along with fine of Rs.10000/- and in default of payment of fine he shall further undergo simple imprisonment for 6 months. (iii) And Under section 5(1)(d) r/w 5 (2) of J&K P Act Samvat 2006, he is convicted and sentenced to undergo rigorous imprisonment of 5 years along with fine of Rs. 10000/- and in default of payment of fine he shall further undergo simple imprisonment for 6 months. All the sentences shall run concurrently and the amount of fine be deposited in the Court. Accused be lodged in ‘District Jail Amphalla’ Jammu to serve the sentence. The convict be given benefit of section 428 CrPC.” The court also issued notice to the complainant for resiling from statement. |
