CAT upholds state’s authority on job qualifications | | | Early Times Report
Jammu, May 13: In a recent ruling, the Central Administrative Tribunal (CAT) in Jammu and Kashmir reaffirmed the State’s prerogative in setting qualifications for government job positions. The decision came following a petition challenging the eligibility criteria for the post of Junior Librarian advertised by the Jammu and Kashmir Service Selection Board. The petitioners contended that their Bachelor’s degrees in Library Science should be deemed equivalent to the prescribed Certificate Course in Library Science. However, the CAT emphasized that the State has the right to determine qualifications for specific posts, as outlined in Recruitment Rules. Highlighting the importance of adhering to recruitment guidelines, the CAT cautioned against violating these rules, stating that such actions would constitute a breach of essential qualifications prescribed for the post. The ruling underscores the principle that the State, as the employer, has the authority to establish qualifications for job positions, and applicants must meet these criteria as per the terms of advertisement. This decision by the CAT clarifies the scope of judicial review in matters of job qualifications and reaffirms the State’s autonomy in setting eligibility criteria for public service appointments. |
