Reconsider seniority, promotion dates of 18 DySPs: CAT

Jammu, Aug 1: The Central Administrative Tribunal (CAT), Jammu Bench comprising Members Rajinder Singh Dogra (Judicial) and Ram Mohan Johri (Administrative),, has directed the Jammu and Kashmir government to reconsider the promotion and regularization dates of 18 police officers who were earlier appointed as Deputy Superintendents of Police (Dy.SPs) on an officiating basis in the year 2000.
The judgment, delivered came in response to Transferred Application No. 5251 of 2021 filed by officers seeking retrospective regularization from the date of their in-charge appointments.
The applicants argued that they had been promoted to the rank of Dy.SP before the appointment of direct recruits of 2002, yet their regularization—done via Government Order No. 367 (P) of 2007—was unfairly backdated after those recruits. They sought corrections either from March 2000 or from dates vacated by their seniors who had been retrospectively promoted to 1997.
While the respondents opposed the petition, the Tribunal ordered the Home Department to treat the application as a representation and decide the matter afresh. The court directed the government to consider the case in light of the Supreme Court's 2000 ruling in Suraj Prakash Gupta & Ors. vs. State of J&K, which held that if an individual is eligible and a vacancy exists, regularization should be from the date of in-charge appointment.
The Tribunal has given the authorities eight weeks to issue a reasoned and speaking order, emphasizing fair treatment and timely communication of the outcome to all applicants. (JNF)
