Jammu, Aug 19: First puisine judge Ramalingam Sudhakar today issued notice to respondents while ordering to keep in abeyance the August 5, 2016 transfer order No 243-PW (Hyd) in respect of petitioners. The court directive came in a petition filed by Naresh Sawhney, Suresh Sethi, Rajesh Sharma, Ravi Kant Sharma and Harpal Singh for restraining respondents from implementing the government order as regards their transfers done without passing a formal transfer order. The judge observed that as it was not a normal case of transfer due to administrative exigencies, the government order be kept in abeyance in respect of the petitioners. The petitioners' counsel submitted that on July 12, 2016, a meeting was called by the respondent, which was attended, among others, by the petitioners and president, vice-president and executive members of the association. It was alleged that in the meeting, the executive engineer (XEn) demanded that the association should withdraw the complaint, alleging malpractices by him, but when it refused to do so, the XEn got infuriated and started abusing and threatening the members and office bearers of the association of dire consequences. He also allegedly threatened them to implicate them in false and frivolous criminal cases by getting an FIR registered against them. (JNF) |
