Rape accused denied bail

udhampur, Dec 3: Ist class judicial magistrate, Ramnagar, Renu Dogra has rejected the bail application of an alleged rape accused.
Accused Parshotam Singh stands booked by police for offences under section 376, 382, 341 and 323 of RPC.
The complainant had on November 8, 2016 lodged a written report at about 7.30 pm, alleging therein that while she was coming home along with her cousin brother when the accused appeared on the scene at Katwalt, posing himself as a CID official. He asked her cousin to stay there and took her to one house and committed rape upon her on the rooftop, she alleged, saying that the accused had threatened to kill her and her cousin in case she 'tells him about the rape'.
After hearing the two sides, the judge said since the accused was said to have committed an offence of rape on the girl, if he was enlarged on bail, it would have an adverse affect on the public at large. The peace loving citizens, like the complainant and her parents, would feel scared about the safety and welfare of their daughter, she observed.
"The offence committed by the accused is an offence against society, especially against women. It has vanished the image of the girl and her character in the society. It has been repeatedly observed that women are being subjected to grave violation and their privacy is being injured. The incidents of rape in the present day society are becoming more common and the offence had gained alarming proportion. The court cannot take an ivory tower approach in matters like this. It must also play its own role in ensuring that the cause of public justice is not abandoned," the judge said.
The court observed that severity of the crime alleged to have been committed by the accused, the supporting evidence and all other connected facts to justify an inference that the accused might misuse the concession of bail to escape the dragnet of law and once that possibility cannot be extended, there are so many aggravating circumstances, which disentitle him from claiming the concession of bail. With these observations, the court rejected the bail application of the accused.
