Prosecution failure leads to acquittal of father, son in 'murder case' | | | Jammu, Feb 26 (JNF): Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Khursheed Hussain and his son Nazir Hussain for committing the murder of close relative for getting the property of the deceased, as prosecution failed. Principal Sessions Judge Poonch Jaffer Hussain Beigh on consideration of all these relevant facts and vital piece of evidence, it can safely be concluded that the involvement of the accused persons is not proved in the instant case. The result is that the prosecution case against the accused persons is dismissed and they are acquitted of the charges framed against them. According to the police case that the information was received from reliable source on 3/8/2009 by Police Station Mandi that the death of Hajra Begum has occurred in suspicious circumstances on 2/8/2008 and the dead body is lying near the house of the deceased. After receiving the postmortem report of the deceased the opinion of the doctor was that the deceased Hajra Begum has died because of strangulation. During the course of enquiry it was established that Mohd Rashied, the husband of the deceased died due to heart attack and he was a Government employee serving in JKAP and on his death the Department sanctioned an amount of Rs.7, 74,000/- in favour of his family members and a house at Kenu as well as at Poonch were constructed. The family was also getting the pension of the deceased Mohd Rashid. The accused Nazir Hussain and Khursheed Hussain, the close relatives of the deceased became greedy to get the property of the deceased Mohd Rashied and proposed the marriage of the accused Khursheed Hussain with the daughter, namely, Iram Mir of the deceased which was refused by the deceased and leading relations strained between the two sides and duo planned to kill the deceased Mst. Hajra Begum. In pursuance of that plan on 2/8/2008 the accused went to the house of the deceased Hajra Begum and strangulated her to death and put her body in the field. After completion of the enquiry offence u/s 302 read with section 34 RPC were established and challan was presented. |
