Prosecution failure leads to acquittal in 'gang rape' case | | | EArly Times Report
Jammu, Feb 28 : Principal Sessions Judge Poonch today acquitted three accused who were facing trial in 'gang rape' case, as prosecution failed to prove its case meanwhile court also issued general arrest warrants against three persons who were declared as absconders and directed concerned office to file be consigned to records after its due completion. Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Mohd Aslam, Showket Hussain Both sons of Lal Din) and Nazir Hussain s/o Aziza who were facing trial in Gang Rape case, as prosecution failed to prove its case. Meantime the court also issued general arrest warrants against Showket Ahmed, Ghula, Nabi and Nazir Ahmed Sheikh who were declared as absconder and directed Office to File be consigned to records after its due completion till the appearance of accused. Principal Sessions Judge Poonch Jaffer Hussain Beigh observed that father of prosecutrix and his aunt have also not stated anything against the accused persons. In view of what has been said and done above the judicial notice cannot be issued against the present above said accused and thus they are acquitted of the charges framed against them and they stand released from their bail bonds. As per police case a report was lodged missing complainant by Mohd Hussain before Police Station Poonch on 15/07/2006 stating her divorced daughter prosecutrix left for the house of her aunt for supply of milk early morning on 2nd July 2006 from where she went to Market and did not turn up. He also mentioned that on July 3, he (complainant) came to know that the accused Mohd Aslam S/O Abdul Ghani, Mohd Showket S/O Lal Din, Mohd Ashraf driver, Mohd Nazir, Abdul Sitar, Ghulam Hussain his tenants had kidnapped her daughter. The report was entered in the Roznamcha vide Report no.16 dtd 4/7/2006 on the basis of which FIR No.98/2006 for offences u/Ss 366, 34 RPC was registered in Police Station Poonch and during the course of investigation police recorded the statements of the witnesses u/s 161 CrPC and recovered the prosecutrix from the house of the accused Showket Ahmed S/O Ghulam Ahmed at Khai Tangam Baramulla and arrested him and produced challan.
