Despite lapse of 4 years no action taken against former DC Srinagar, ex-MLA Amira Kadal | Commercial property worth crores sold for lakhs in summer capital | | Jehangir Rashid Early Times Report
SRINAGAR, Mar 22: At a time when the state government is seriously thinking of taking action against the violators of Municipal Laws in Srinagar and Jammu, it first needs to take action against officers and politicians who encouraged under valuation of some of the commercial properties in summer capital of the state. One such case is of former Deputy Commissioner, Srinagar, Mehraj Ahmad Kakroo. Kakroo undervalued a commercial property in the heart of Srinagar city some four years back. The then Divisional Commissioner Kashmir, Asgar Hassan Samoon after detecting the fraud ordered for the lodging of First Information Report (FIR) against then Deputy Commissioner, Srinagar. On April 19, 2011, Samoon after finding something fishy in a case of mutation ordered for registering FIR against Kakroo. Almost four years down the line no FIR has been registered against Kakroo who is nowadays Managing Director, Jammu & Kashmir State Power Development Corporation (J&K SPDC). "It is prima facie observed that mutation has been attested under Roshni for the share of the deceased lessee. Besides, an amount of 30 lakhs has been deposited against the assessed amount of rupees one crore per kanal. FIR needs to be lodged against the delinquents and Deputy Commissioner concerned," writes Samoon in the order DivCom/Reader/K/99-102. The then Divisional Commissioner, Kashmir further wrote in the order, "However, Additional Deputy Commissioner and Assistant Commissioner Nazool will proceed on spot and get the land located/demarcated and have a detailed report submitted to this court within a period of fifteen days after perusal of records and spot." Samoon passed the order on the petition of one Ali Mohammad Bhat son of Abdul Ahad Bhat resident of Nawab Bazar, tenant of shop number 10 Banaras Silk Emporium Shopping Complex Srinagar. Ali Mohammad moved the petition while seeking revision of order of mutation number 486 dated 23-11-2010 of estate Kothi Bagh Srinagar with the prayer for setting aside the same. The then Additional Deputy Commissioner, Srinagar and Assistant Commissioner Nazool along with some other officers visited the spot and they substantiated the petition of Bhat. The officers recommended for taking action under laws against the violators. "That the spot inspection, examination of records, report of the B.O.C.A Inspecting Officer, SMC and Nazool correspondence is reflective of the fact that Hotel Sabreena area, was under the lease of deceased ex-lessee Bakshi Bashir, who had sub-let the same to the present occupants who are in possession of the premises (applicants herein)," said the report submitted by the team of officers. The report further wrote, "It may be in place to state before processing the state under Roshni, the applicant has to produce Shajrakate, duly attested by Naib Tehsildar, which is a pre-requisite for transfer of ownership, the mutation number 475 is self explanatory that this has not been done, thus lacking credence." "In view of the aforesaid factual inspection it is obviously inferred that the petitioner's application is based on facts. Hence this report is submitted for favour of kind perusal and necessary action under law," said the report. The report was submitted under order number 124-25/N/Per dated 18-7-2012. After the submission of the report the deal was supposed to be cancelled, but that was not to be. The then MLA Amira Kadal, Nasir Aslam Wani used his political clout and influenced the administrative machinery not to cancel the deal. As such the property that could have fetched crores of rupees was sold for few lakhs. |
