Kapahi quits as Govt advocate, exposes rot in the system | | | Kunal Shrivatsa Early Times Report
JAMMU, Apr 28: Apparently unhappy over appointment of much junior lawyers on key law officers' posts, a senior lawyer Parveen Kapahi has tendered his resignation as a government advocate, lending credence to the accusations that such appointments are made on political considerations. In his resignation letter, which was submitted to the Advocate General on Monday, Kapahi has alleged that not only lawyers much junior to him have been assigned superior posts like Additional Advocate Generals and Deputy Advocate Generals but there are some advocates who were given senior ranks even though they don't posses the required law practice experience. "I may submit having earned good reputation on legal field and handled skillfully almost 9,000 to 10,000 cases in my professional career in High Court and subordinate courts. I was expecting good deal from the government considering my talent and calibre to defend the government cases," Kapahi says in the letter, a copy of which is in possession of Early Times. "Whereas law officers appointed in this list are those advocates who had just retired from government services having no experience or less experience which is below the requisite qualification and mark to be appointed for these posts. "I am long standing as advocate of various departments and I have been continuously working with almost 25 government departments/semi government/corporations. Apart from this I have remained central government standing counsel in J&K High Court for a period of 13 years and also remained incharge litigation J&K State CAT Bench, Chandigarh for similar tenure," he added. With the resignation of Kapahi, the cat has come out of the bag as his contention that despite having vast experience of serving central government organizations, the state government had not selected him for the post of Additional Advocate General. Also, his candidature was even ignored for the post of Deputy Advocate General even as lawyers with no experience of appearance before the HC were selected. Meanwhile, sources informed Early Times that it is an open secret that posts of law officers are being influenced by the politicians. "Persons who are incompetent, having no caliber and no experience, enjoy the plump posts whereas talented and experienced advocates are always pushed to the wall," the sources said. "One such glaring example is Bharat Singh Jamwal who retired from Jammu Municipal Corporation last year and has been selected for the post of Deputy Advocate General despite having no law practice experience," they added. The sources said that law officers should be law-knowing persons and not "political leader-knowing persons". "The law officers conduct cases on behalf of the state and not at the instance of the ruling party. Appointment of law officers must be based on merit, ability and integrity alone," said the sources. |
