| Court rejects closure report filed by Police | | | Early Times Report
Jammu, Apr 28: Special Municipal Mobile Magistrate Jammu Ashwani Kumar Sharma in a significant order has rejected the closure report (ikhtami) filed by the SHO Police Station Peer Mitha Jammu. Special Municipal Mobile Magistrate passed this significant order after hearing the counsels for the petitioner A K Sawhney and Aseem Kumar Sawhney with Neeraj Singh and Ajay Sharma Advocates whereas Sr PO Anil Dev Jamwal appearing for police observed if the allegations made in the application moved u/s 156 (3) CrPC and the statement of the complainant Aradhana Kumari as well as her witnesses on record are to be taken into consideration in their entirely at their face value then prima facie there is sufficient evidence to proceed against the accused Tapeesh Dutta u/s 354 RPC. So far as the commission of offence u/s 420/406 RPC are concerned there is no sufficient material on record and the proceedings u/s 420/406 RPC against the accused are hereby dropped. Court also said process for the commission of offence u/s 217 RPC is also issued against the I/O Khursheed Hussain No. 795473/EXJ and accordingly the said I/O, be also summoned before the court for his attendance." —(JNF) |
