Tainted Budgam court PP to be removed | ET Impact | | Early Times Report
Srinagar, May 3: Taking cognizance of a petition, the J&K High Court has directed the Law Secretary to consider the removal of Public Prosecutor (PP) in the Sessions Court Budgam in view of his tainted track record. The petitioner whose sister was murdered in June last year has alleged that the PP was trying to give undue benefit to the accused who is currently lodged in Central Jail Srinagar. Details available with Early Times reveal that a murder case of a young from Kremshore, Budgam was pending in Sessions Court Budgam for the disposal, but the girl's brother Javaid Ahmad Sofi alleged that the PP was trying to help the accused in lieu of illegal gratification. In this regard he had requested Law Secretary to appoint a Special PP so that there was no undue influence on part of the incumbent PP. Javaid's request was not accepted and this forced him to knock the doors of High Court. High Court's single bench under Justice Ali Mohammad Magray issued an order on 30/4/2015 directing the government to take action against the tainted PP. The order reads: "Secretary to Government Law Department shall consider the removal of (PP) and also explore the possibility of appointment of Special (PP) in the case and report compliance on next date of hearing." Earlier the residents of Budgam had appealed Law Justice and Parliamentary Affairs Minister Basharat Ahmad Bukhari to appoint new (PP) at Budgam Sessions Court as the incumbent (PP) is "still fleecing the poor people of the district in one way or the other." The incumbent PP Sheikh Nayeem Ahmad is already facing charges of corruption as he was caught red handed by the Vigilance few years ago. Pertinently, Nayeem played an important role to bail out self-styled faith healer and rape accused Gulzar Bhat alias Gulzar Peer of Latter, Chadoora. The rape victims who had accused Gulzar Peer of sexually exploiting them had also alleged that the PP had been bribed by Gulzar Peer's men. The tainted PP who is looking after Gulzar Peer's case was also caught red handed by Vigilance officials while accepting a bribe of Rs 10,000 (1st installment) from a man whose father's murder case was pending before the same court. The local media as well as TV channels like CNN IBN had made this issue public and filed detailed stories as well. A case under FIR No: 04/2014 under sections 5 (2) PC Act 2006 stands registered against him at Police Station Vigilance Organisation Shaheed Gunj, Srinagar.
