Cabinet to take call on Food Safety Act today: AG tell HC

Srinagar, June 1: Will ruling alliance of PDP-BJP adopt National Food Security Act in the state? The answer is likely to be known on Tuesday. According to Advocate General R A Jan the decision is being taken by the cabinet which is meeting at civil secretariat tomorrow.
This was disclosed by Jan before a division bench of Chief Justice N Paul Vasanthakumar and Justice B S Walia during the hearing of a Public Interest Litigation filed by one Tariq Ali Najar of Pulwama. Following the statement by Jan, the court posted the PIL for further consideration on 8-7-2015. Assistant Solicitor General of India S A Makroo also informed the court about a communication addressed by undersecretary to minister of CAPD department to Commissioner Secretary J&K, informing him about the decision of the government for the distribution of additional food grains of 1523 tons of wheat and 3180 tons of rice per month during April to September 2015 or till implementation of the NFSA.
Makroo said that the government of India allowed the time to the J&K along with other states, who are yet to implement the Act, till September to complete the necessary formalities regarding implementation is the legislation.
The Government of India has enacted National Food Security Act (NFSA) in 2013 which provides for allocation of food-grains under Targeted Public Distribution System (TPDS) to the states and UTs that have implemented the Act. The state of J&K has not implemented NFSA and as such food grains in are distribited in keeping with 2001 population estimates with each family getting 35 Kgs per month irrespective of its strength. The petitioner is seeking directions for proportionate increase in allocation of food grains. "NFSA covers only 75% of the rural and 50% of the urban population under TPDS," petitioner pleads. The petitioner submits that the eligible family member be entitled to receive 5 kgs of food grains for a month at subsidized price of Rs 3, 2, 1 per kg of rice, wheat and coarse grains saying "the Act is silent regarding the unsubsidized food grains".
