HC directs authorities to pay Rs 5 lakh to torture victim | | | Early Times Report Srinagar, Aug 28: A division bench of the state high court has directed concerned authorities to pay Rs 5 lakh as compensation to a man who suffered bone fractures allegedly after custodial torture by Border Security Force. The bench of Chief Justice N Paul Vasanthakumar and Justice Hasnain Massodi ordered the compensation to Mohammad Amin Sofi, who was arrested on June 23, 1994 by BSF at Neelam Chowk here. He subsequently filed a writ petition in high court and sought compensation of Rs 5 lakh for his medical treatment for the torture he was allegedly subjected to during the custody. However, a single bench of the court had dismissed his petition for raising 'disputed questions'. Sofi challenged it before the division bench which directed Principal District and Sessions judge Srinagar to conduct an inquiry into the matter. The inquiry report submitted before the court revealed that Sofi had earlier suffered a fracture which was quite distinct from the one he suffered in 1994. "Let the amount be paid within three months from the date of judgment where after it will carry interest at the rate of 9 per cent," the bench said. |
