KAS final seniorty list challenged | HC restricts state from initiating process of induction into IAS | | Early Times Report
Jammu, Apr 26 : High court judge B S Walia has directed state to go a head with the process of promotions but not to act upon the process of making promotions to KAS and induction into IAS. The court directive came in a petition challenging the final seniority list of KAS. An application was also filed in the high court today, seeking direction to state for restraining it from making further promotions and adjustments in special scale KAS cadre and higher scale KAS cadre posts. A direction was also sought for restraining state from making inductions into IAS till disposal of the writ petition. The applicant's counsel submitted that the state government had now initiated the process of making further promotions of the officers whose induction and seniority in KAS cadre was under challenge. The said process was going on and in case those officers were promoted, irreparable loss would be suffered by the petitioners and it would give rise to multiplicity of litigation. The litigation would also get prolonged in case further process of promotion to higher scales was not stopped. The respondents had also initiated process of making inductions into IAS cadre in favour of the said officers and in case it wass done, petitioners would again suffer irreparable loss and would be required to challenge such inductions. "It is in the interest of justice to stop this process. It may not be out of place to mention here that Supreme Court had also stopped promotion in Special Scale Cadre and the division bench had also passed similar interim directions and said that in view of the changed circumstances, the further process of promotion to higher scale KAS cadre posts and IAS cadre posts deserves to be stopped till final decision of the writ petition," the counsel said. |
