Early Times Report
JAMMU, May 27: While the high court is scheduled to hear a contempt case against an ex-SHO of Pacca Danga police station Saturday, the accused in the girl's death due to burning at Zanana Park here has been arrested by police after three years of the incident.
Accused Sanjay Sharma, who was arrested two days or so back, was likely to be produced before a lower court tomorrow. He was absconding after the girl's death due to burning at Zanana Park about three years back.
The victim's mother Lal Zohra, wife of Mohammad Aslam of Shaheedi Chowk, has been fighting a legal battle since the death of her daughter.
Police have presented challan in the court against the accused under sections 309 and 109 of RPC.
Lal Zohra had also filed a contempt petition against Inspector Kuldeep Khajuria, ex-SHO of Pacca Danga police station, in which CJM Suneet Gupta had found him guilty and referred the matter to high court for adequate action for committing criminal contempt of the court.
Her counsel earlier submitted that she had filed a complaint under section 302 of RPC against accused Sanjay Sharma as he had allegedly killed her daughter by setting her ablaze at Zanana Park.
On the high court direction, second statement of the victim, who later died, was got recorded at DMC, Ludhiana, wherein she had stated how the accused had burnt her. Despite the girl's statement, police probe made no headway.
When the CJM called then SHO of Pacca Danga police station in person, he produced before him an order dated October 11, 2013, whereby the high court had directed that the statement of the victim be recorded but it should not be used till further orders by it.
After Kuldeep Khajuria produced this order and submitted that petition before the high court was pending, CJM disposed of the petition observing that nothing could be done further.
The counsel told the CJM's court that the high court order produced by Inspector Kuldeep was already vacated in December 2013 and that he had misled the court which amounted to contempt of court.
Meanwhile, the contempt petition referred by CJM against Inspector Kuldeep (now SHO of Trikuta Nagar police station) was scheduled to be heard tomorrow by a high court division bench.
The counsel also alleged that police moved slow in the case because accused Sanjay's brother was a police Inspector.
