HC directs Revenue Secy to file updated status report or appear in person | Alleged hushing up of Chatta-Sunjwan land scam | | Early Times Report Jammu, May 27: In a PIL on the alleged hushing up of Chatta-Sunjwan land scam, a high court division bench of Justice Ali Mohammad Magrey and Justice B S Walia today granted two weeks time to the revenue secretary to file updated status report in terms of the April 28, 2016 order or appear in person on the next date of hearing. After hearing the counsels of petitioners, revenue department, newly impleaded revenue officials and JDA, the bench expressed its displeasure over the non-filing of status report by the revenue secretary in terms of the April 28, 2016 directions of the bench when revenue secretary Mohammad Afzal Bhat had appeared in person and had sought more time to file the status report after gathering inputs from the divisional commissioner, Jammu, and the deputy commissioners of various districts of Jammu province. The petitioner's counsel said the revenue secretary was under an obligation to file the status report with regard to two issues -- one pertaining to government order No 44 Rev(S) of April 1, 2016 whereby revenue department appointed regional director, settlement and survey, Jammu, as inquiry officer to fix responsibility and identify those who had tampered the revenue record of Sunjwan as pointed out by then divisional commissioner, Jammu, Shantmanu in his inquiry report. The inquiry officer was asked to submit his report within 15 days but despite the expiry of almost two months, the report was yet to see the light of the day. He sought a direction to the revenue secretary and the inquiry officer to produce before court the inquiry report in a time bound manner to know about the names of revenue officials involved in the tampering of revenue record. He said the revenue secretary was also under an obligation to file an updated status report with regard to the alienation of 724 kanals of land at Sunjwan in favour of M/s SRK Associates as he himself had found discrepancies in the inquiry report submitted by SDM, Jammu (south), Shahid Mehmood who had been appointed as inquiry officer by the government vide order No 151-Rev(S) of October 7, 2015. Shantmanu was also said to have concluded in his inquiry report that 20 kanals of state land in khasra No 1442 had been put to sale by apparent tampering with the record. After hearing him, the bench granted two weeks time to the revenue secretary to file updated status report in terms of its last order of April 28 or appear in person on the next date of hearing. |
