Finality of judicial proceedings must to maintain rule of law: HC | | | Early Times Report
Jammu, Aug 26: A high court division bench of Chief Justice N Paul Vasanthkumar and Justice Tashi Rabstan today held that finality of judicial proceedings between the parties had to be maintained to main the rule of law. The court directive came in an appeal filed by PSC against the order made in contempt petition No 509 of October 15, 2015, holding that the order passed by PSC on April 3, 2013, rejecting the claim of first respondent 'does not amount to the compliance of the November 10, 2010 judgment of Writ Court and the appellant was directed to comply with the Writ Court judgment and file a fresh compliance report before the next date of hearing. The bench held that finality of judicial proceedings between the parties had to be maintained to maintain the rule of law. "If the argument as advanced by the appellant's counsel is countenanced, it will have disastrous consequences in the administration of justice as any order can be defied by the authority by stating that the person who got the relief is not entitled to get the relief for a reason which was not raised or argued at the appropriate stage," the court observed.
