Alleged hushing up of Chatta-Sunjwan land scam | HC directs DGP to monitor probe | | Early Times Report
Jammu, Oct 17: Disposing of PIL highlighting the alleged hushing up of Chatta-Sunjwan land scam, a high court division bench of first puisne judge, Justice Ramalingam Sudhakar and Justice B S Walia today directed the DGP to monitor the ongoing CB (crime branch) probe into the land scam. The matter was referred to CB by the general administration department in September 2015. The court directed CB to conclude the probe in a non-partisan manner. GAD was also directed to ensure that the CB probe was concluded without any further delay. The bench observed that looking into the nature of the case, no time period could be fixed for completion of probe but the investigating officer was expected to finalise it in a time bound manner. After hearing the senior AAG and counsels for the petitioner, SRK Associates, revenue officials and JDA, the bench directed the de-linking of Miscellaneous Petition and directed the Registry to list it separately and also directed the HUDD secretary and JDA VC to respond to the Miscellaneous Petition within two weeks. It was submitted that notices in the Miscellaneous Petition were issued to the secretaries of GAD and HUDD, besides JDA VC, on September 16, 2015, requiring them to file their response but no response was filed and further time was allowed by the bench on November 3, 2015 but till date, response to the said Miscellaneous Petition was awaited. The counsel sought appropriate directions to the senior functionaries in view of the non-filing of the response to the MP. At this stage, counsels for SRK Associates submitted that the petitioner was protracting the litigation and the said issue was never the part of the original relief claimed in the PIL. They argued that a valid building permission was granted in favour of SRK Associates and no interference was warranted in the matter. After hearing them, the bench observed that the inquiry in the matter 'stands already completed by then divisional commissioner Shantmanu and action has also been initiated on his inquiry report by GAD by referring the matter to CB for a thorough probe'. With regard to disciplinary action in the matter, revenue officials' counsels told the bench that they had already been chargesheeted by the financial commissioner (revenue). They also submitted their statement of defence. The bench, after noticing the various prayers made in the PIL, observed that the relief prayed already 'stands allowed and certain reliefs had been rendered infructuous in view of various orders passed from time to time in this PIL. The bench directed the Registry to list the MP separately after two weeks with a direction to the concerned respondents, ie secretaries of GAD and HUDD, besides JDA VC to respond to it. With these observations, the bench disposed of the PIL, directing the DGP to monitor the ongoing probe into the land scam. Directions were also issued to GAD and CB. (JNF) |
