Airport Authority challenges Suo-Moto order of SHRC

Jammu, Mar 5: In a petition filed by Airport Authority of India challenging the Suo-moto congnizance of the SHRC regarding overcharging by food outlets at the Airport of Jammu and Srinagar, a Division Bench of the State High Court Comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar after hearing Adv Inderjeet Gupta for the Airport Authority of India, issued notice, and ordered that there shall be stay on operation of the order dated 29.05.2017 & the order dated 11.12.2017 passed by the J&K State Human Rights Commission.
The SHRC had observed that some Restaurants and at some public outlets in both the airports, packaged commodities (food items etc) were being sold at the price more than MRP and also declaring dual MRP on the same packaged commodities in violation of legal Metrology Packaged commodities Rules, 2011 and the legal Metrology Act, 2009. The public is being charged at higher rates thus putting them at huge monitory losses. This is being done under the nose of higher officers and within the knowledge of the officers at the helm of affairs and also challenge the order regarding inquiry is conducted by SSP Airport Jammu and Srinagar.
During the course of hearing Adv Inderjeet Gupta submitted that Commission has no jurisdiction to entertain such type of complaints because Section 2(c) of the Human Rights Act states that Human Rights means the rights relating to life, liberty, equality and dignity of the individual guaranteed by the Constitution or embodied in the International Covenants and enforceable by the courts in India. It was further submitted that SHRC have no jurisdiction to pass directions for conducting enquiry by SSP Airport Jammu / Srinagar.
