HC orders status-quo on shifting of Fruits, Vegetable Mandi | Relief to Akhnoor Farmers/Agriculturist | | Early Times Report Jammu, Mar 5: In a major relief to farmers/agriculturist of Akhnoor who were asked by the administration to shift the 25 years old Akhnoor Mandi to Daskal Mandi, Justice Alok Aradhe of J&K High Court Jammu Wing after hearing Adv Vishal Kapur for the petitioners, issued notice to the respondents and ordered Status-quo till next dale of hearing. The direction came in a petition filed by Adv Vishal Kapur seeking quashment of Section 41 of Jammu & Kashmir Agricultural Produce Marketing (regulation) Act 1997 as ultra-vires to the Article 14 & 19(g), of Constitution of India. During the course of hearing counsel for the petitioners submitted that the Petitioners were petty local farmers who have been selling their agricultural produce at fruit and Vegetable Mandi, Akhnoor for the last more than twenty-five years. The petitioners include farmers who come with one basket of fruits or vegetables ranging to farmers who come with a Tractor-trolley or cart full of vegetables. Most of the farmers come on buses or matadors (TATA -407) and get down near Akhnoor Mandi with their produce and sell it in the existing Mandi directly to consumers, retailers and also to some wholesale dealers. Justice Alok Aradhe after hearing Adv Vishal Kapur at length directed that in view of the aforesaid submissions and in the facts of the case, it is directed that the status-quo as exists today shall be maintained till next dale of hearing. |
