HC rejects bail of wife & Ors in murderous assault on Lawyer

Jammu, Mar 5: Justice M K Hanjura has dismissed the Anticipatory Bail applications of Ajay Gupta S/o Late Banarsi Dass Gupta R/o H.No.-516,U .No Lane, Talab Tillo, Jammu, Amit Gupta S/o Late Mohan Lal Gupta R/o Talab Tillo, Jammu H.No:3, Lane No. 4 Bhawani Nagar, Jammu and Amisha Gupta W/o Vishal Mahajan D/o Ramesh Chander Gupta, Kusum Gupta W/o Ramesh Chander Gupta Both R/o Vikas Lane, Talab Tillo, Jammu wherein they had sought pre arrest bail in an FIR under section 307 RPC (attempt to murder) registered at Police Station Channi Himmat Jammu.
Infact Amisha Gupta is the estranged wife of Vishal Mahajan (Advocate) S/o M.P. Gupta (Advocate) R/o H.No. 229, Sector-6 ; Channi Himmat, Jammu and Kusam Gupta is the mother in law of Vishal Mahajan whileas Ajay Gupta and Amit Gupta are cousin brother and brother in law of Amisha Gupta, who alongwith two others had committed a murderous attack on the victim Vishal Mahajan as per the FIR.
High Court after hearing Mr. D.S. Saini, Advocate for the petitioners while Sr. Advocate Sunil Sethi with Adv Aseem Sawhney for the complainant Vishal Mahajan, whileas Mr. S.S. Nanda, Sr. AAG for the State dismissed these bail applications.
"What needs to be stated at the outset is that the applicants filed two applications incorporating the same prayer as raised in these applications before the Court of First Additional Sessions Judge, Jammu, primarily, on the same grounds as have been agitated in these applications for the grant of bail in anticipation of arrest in their favour. Both the applications met the same fate and were dismissed by order dated 11.11.2017 of the learned First Additional Sessions Judge, Jammu " the Court observed.
The factual background of the case is that on 11th October, 2017, Vishal Gupta S/o Mahinder Parkash Gupta R/O H.No. 229 Sector 6 Channi Himmat lodged a written report before the authorities at Police Station Channi Himmat Jammu, stating therein that accused Ankit Gupta and Mohit Gupta launched murderous attack on him.
Ankit Gupta and Mohit Gupta were arrested during the course of investigation of the case. It is stated that it was at their behest that the weapons of offence allegedly used by both of them in committing the offences were recovered.
The High Court in its Order further observed that in the present case, the accused are allegedly involved in the commission of offences under Sections 307/452/147 RPC and 4/25 Arms Act and out of the accused involved in the said occurrence, only two of them namely Ankit Gupta and Mohit Gupta were arrested on 12th and 13th of October 2017 and they were released on bail on 28. 10.2017 by the Court of learned CJM, Jammu. In view of the preceding analysis, there appears to be no merit and substance in the applications of the applicants. These entail dismissal and are, accordingly, dismissed.
