Rejects application seeking flood relief details Tehsildar Pattan unaware of RTI Act 4/9/2018 11:44:26 PM Early Times Report Srinagar, Apr 9: 9 years since the enactment of RTI act in the state, a KAS officer who is posted as Tehsildar is still ignorant of its provisions and has rejected an RTI application without assigning any reasons. Information seeker had filed an application seeking to know about the details of flood relief disbursed in Pattan area, but the Tehsildar out rightly rejected the application saying application has not been filed in accordance with RTI Act / rules. Details available with Early Times reveal that one Karar Hassan Reshi R/O Hagarpora Budibugh Teshil Pattan district Baramulla filed an RTI application before Executive Magistrate (Tehsildar Pattan) on 6.3.2018. Information seeker sought details about relief provided to flood victims of his area. Instead of providing the information Tehsildar vide his RTI reply No: Teh/ Ptn/OQ/RTI/153-55 Dated 28.3.2018 denied information and rejected the application. The reply reads: "An application / request made is hereby rejected as having not filed in accordance with rules of J&K RTI Act 2012." "Tehsildar Pattan seems to be unaware that J&K RTI Act was enacted in 2009 and there is no RTI law known as RTI Act 2012. It is a matter of serious concern that inspite of 9 years of enactment of RTI in J&K, officers especially the designated PIOs are still unaware of RTI Act" said Dr Raja Muzaffar Founder RTI J&K Movement. RTI activist Karar Rehsi has now planned to file 1st appeal before Additional Deputy Commissioner Baramulla against the order of PIO ie Tehsildar Pattan. In a similar case an application ACR Budgam who is also Collector Land Acquisition (LA) Budgam rejected the application frivolous grounds. "Govt is under legal obligation to create awareness on RTI and section 23 of J&K RTI Act 2009 lays emphasis on this. It seems PIOs have not been trained by the Govt.
