Court rejects bail in culpable homicide not amounting to murder | | | Early Times Report Jammu, June 10: Judicial Magistrate Samba Shabnam Sheikh rejected the bail application of one Bhagat Singh s/o Sahil Singh allegedly involved in 307/304/ 30 Arms Act. According to the police case, complainant Sanjay Singh Son of deceased Kama Devi mentioned in his complaint that on 16.05.2018 accused Bhagat Singh due to old enmity with his family members entered into his house with 12 Bore Rifle with criminal intention and started beating his father with fists & blows and with the butt of 12 bore rifle and when his mother Kama Devi tried to rescue him, Bhagat Singh also attacked his mother and due to that she died on spot. On this report. FIR got registered and investigation began and during investigation the statement of Sanjay Singh got recorded u/s 164-A Cr.P.C in the court. In his statement, he became totally hostile and stated that her mother died due to fall and the husband of deceased also gave the same statement u/s 164-A Cr.P.C before the court . Judicial Magistrate Samba Shabnam after hearing Adv Ganesh Sharma for the applicant whereas Prosecuting Officer Tanveer Khatana for the State, observed that the accused person is alleged to have committed offence U/Ss.304,307 RPC, which itself is a serious offence against the society at large. The investigation of the case is in progress and the release of accused at this stage will be prejudice to the prosecution case. With these observations Court rejected the bail application. |
