Relief to flood victim in Kashmir released | ET Impact | | Early Times Report JAMMU, June 10: Relief of a flood victim was released after Early Times carried two stories on April 9 and April 12, 2018 regarding rejection of an RTI Application by Tehsildar Pattan (PIO) and the filing of its first appeal before First Appellate Authority (FAA). The case was heard by the concerned First Appellate Authority who although passed a bogus order but the relief amount of Floods of 2014 in Kashmir was credited to the Bank Account of the flood victim namely Syed Ali Shah of village Hagerpora. Earlier, the Early Times had reported that even after 9 years of enactment of RTI Act in state, a KAS officer who is posted as tehsildar is still ignorant of its provisions and has rejected an RTI application without assigning any reason. Information seeker, Karar Reshi, had filed an application on 6.3.2018 seeking to know about the details of flood relief disbursed in Pattan area, but the Tehsildar vide his No: Teh/ Ptn/OQ/RTI/153-55 Dated 28.3.2018 denied information and rejected the application saying application has not been filed in accordance with J&K RTI Act 2012. It was highlighted by Early Times that no such Act exists and the PIO is himself unaware that only one RTI Act i.e. J&K RTI Act 2009 exists as of present. The report was widely shared on social networking sites and the sources have said that the concerned PIO was castigated by senior officials for wrong interpretation of the RTI Law. Karar Reshi, the District Coordinator (Baramulla) of J&K RTI Foundation, said, "The flood victim namely Syed Ali Shah of village Hagerpora whose flood relief installment was pending since 2014 was denied relief by Tehsildar Pattan by saying that there is a vigilance complaint against the flood victim. "I felt very happy to see the smile on the face of old man after he got money in his account. RTI has proved to be the only Law that could provide justice to this old man", he added a d hailed early times for its RTI reporting. Further when the Appellant moved the first Appeal in the court of Additional Deputy Commissioner (ADC) Baramulla who is Fisrt Appeallate Authority, the story was again carried by the Early Times on April 12, 2018 and widely shared on social networking sites. Early Times viewed that it is the responsibility of the State Government to conduct awareness programmes for awareness of its officials as per Section 23 of J&K RTI Act 2009. The applicant, Karar Reshi, is not satisfied with the decision of the First Appellate Authority even if the concerned Tehsildar has credited flood relief installment to the flood victim and is planning to file Second Appeal before the State Information Commission. He demands the penalizing of such officials who are denying information by misleading applicants and wrongly interpreting the law. |
