DB directives in PIL highlighting poor working of SPCB | | | Early Times Report Jammu, June 16: In a Public Interest Litigation filed by Adv Rajinder Singh Jamwal highlighted the poor working of State Pollution Control Board (SPCB) especially there is hardly any arrangement for testing the quality of air. The petition pointed out that in the absence of pollution check at government laboratory level most of the industrial units have seek help from private laboratories for getting the sample tested which is in violation of law because no authenticity has been attached to these reports. A Division Bench of State High Court Comprising Justice Dhiraj Singh Thakur and Justice Sanjay Kumar Gupta observed that Joint Commissioner (Works), Jammu Municipal Corporation has submitted his status report in regard to solid waste management. It is stated that two Companies, namely, AG ENVIRO Infra and Antony Lara Enviro Solutions and Excel Industries have been short-listed and have been found to be technically qualified. It is stated that the file has since been submitted to the Housing and Urban Development Department for further orders in the month of May, 2018. Upon this division Bench directed Housing and Urban Development Department shall consider the proposal submitted and appropriate decision be taken thereupon within two weeks. With regard to the e-waste management, it is submitted that keeping in view the e-Waste Management Rules, 2016, a draft action plan for e-waste management of Jammu City has been submitted to the Housing and Urban Development Department for further appropriate action. Upon this DB said that this also shall be considered by the Housing and Urban Development Department and appropriate decision be taken within two weeks. Rohit Kapoor, AAG appearing for the respondents submitted that with a view to implement the entire project prepared for e-waste management at least three months time is required. However, in our view, the project can be initiated, as a pilot project, in certain zones or in certain areas and the expansion can take place therefrom. To begin with major institutions, which have been mentioned in the report, can be identified for commencement for this pilot project. Court ask AAG Rohit Kapoor assures that the pilot project would commence within one month. DB further observed that it appears that with a view to determine the quality of air, the Central Pollution Control Board has sanctioned, in all, 16 quality ambient air monitoring centres, out of which 03 have already been established. Rohit Kapoor, AAG submits that with a view to establish newly sanctioned 13 centres for Jammu region, the requisite funding is required, for which, a proposal has already been sent to the Central Pollution Control Board. The sanction also appears to have been accorded by the Central Pollution Control Board vide their communication dated 10.01.2017. DB directed Central Pollution Control Board is, accordingly, to release the money in terms of the sanction already granted within two weeks so that the requisite Centres can be set up at the earliest by the State Pollution Control Board. DB further directed Central Pollution Control Board would also consider release of funds for making operational the Centres which are already in existence and also for setting up of new quality ambient air monitoring Centres as per the sanction. |
