DHS Kashmir serves showcase notice to DAK
Availing holiday 'unethically'

JAMMU, June 16: Active in the Valley, the Doctor Association of Kashmir (DAK) is likely to face action for allegedly unethically availing holiday on account of Shab-e-Qadr on June 12.
The Director Health Service (DHS), Kashmir has served showcase notice upon the office bearers of DAK.
"You are claiming to be the office bearers of (DAK) which is not a registered association and you have availed 12th of June 2018 as a holiday which you were not supposed to avail. You have instigated and provoked other doctors for the same, which is totally un-ethical and criminal for you being the employees of the Essential Medical Service which is directly related with the life saving of the poor patients", DHS said in the notice served to DAK on June 13.
"Declining to discharge your legitimate duties of attending patients, administering medical treatment, and make efforts to save serious patients cannot be accepted for any reason whatsoever. The demands put forth by the your so-called association, including two and half clay incentives for attending Gazetted Holidays, were being considered by the government and a committee was framed by the government under order No:340-HME of 2018 ciated:01/06/2018, but instead you continued to proceed on self-proclaimed holiday unethical and which has resulted in insubordination and indiscipline besides affecting the poor patents badly who visit the government hospitals for treatment", the notice reads.
The DHS Kashmir further said that the people protest to get their demands fulfilled "but you have resorted to unauthorized absence and self-declared holiday which is not even a mode of protest but a refusal to act as per the established practice and procedure in this department since its Inception. "Working on Gazetted holidays has been in vogue since the beginning of the health services department and also when you joined this service you were fully aware about such service and duty schedules. Such practice proves your professional misconduct and unethical approach which is also in violation to the Essential Services and Maintenance Ordinance 2001", the notice further reads.
"Your actions demand a disciplinary action as per the judgment of Supreme Court passed In W.P. No:253 of 2012 titled "People for Better Treatment Vs Secretary Indian Medical Association and others" and as per the subsequent Circular instructions issued by the Medical Council of India. Your instigation, provocation and compelling of other doctors to resort to unauthorized menace through different means including social media like Whatsapp face-book etc. has resulted In chaos and mismanagement and the poor patients which were dated for surgeries from last four months have not be operated", the DHS said.
It added: "You have driven more than 300 poor patients, requiring surgeries and hundreds of patients requiring medical consultations (in OPD) to private sector which has put a huge financial burden on poor patients besides putting their live at risk and some of them have been left at the mercy of God.
"Medical professionals are highest paid in the society and the salary structure of doctors is best as compared to other Gazetted Officers of the state. Your status in the society is most cherished because of your services and not because of your posts. The dated surgeries have been postponed thereby putting at risk the lives of poor patients. You have created a complete chaos, mismanagement and in obedience and have brought disrepute to this noble profession.
"Before taking disciplinary action against you under Civil Services Rules, Classification Control and Appeal Rules, Essential Services & Maintenance Act, various directions of Supreme Court of India and Circular Instructions dated 2015 of Medical Council of India, you are hereby asked to explain your position in this behalf within (2) days positively. Failing which action as warranted under rules shall be initiated against you for such un-ethical practice and disobedience without further notice, which may include termination from Government Services and or cancellation of your State Medical Council Registration."
