HC asks 13 judges to provide information on lawyers strike

Srinagar, July 25: The State High Court on Wednesday directed thirteen Principal District and Session Judges to furnish the information, data on strikes, abstaining from work by lawyers, loss caused and action proposed during the last three months.
"As such, I am directed to request you to expedite the matter at an earliest and without any further delay," the court's joint registrar said in the communication sent to principal district and sessions judges of Rajouri, Poonch, Bhaderwah, Udhampur, Samba, Jammu, Kishtwar,, Ganderbal, Shopian, Pulwama and Kulgam.
The Supreme Court has held that suspension of court work or strikes are clearly illegal and it is high time that the legal fraternity realises its duty to the society which is the foremost.
Terming strikes by lawyers as illegal for obstruction of access to justice, the Supreme Court has decided to act tough against erring advocates and Bar associations that passed resolutions for strike.
"It is well known that at some places there are frequent strikes, seriously obstructing access to justice. Even cases of persons languishing in custody are delayed on that account. By every strike, irreversible damage is suffered by the judicial system, particularly consumers of justice. They are denied access to justice. Tax payers' money is lost on account of judicial and public time being lost. Nobody is accountable for such loss and harassment," the bench had noted in its judgment.
