| Today we are celebrating 71st Accession day of Jammu and Kashmir with the rest of India. It was on this day in 1947 when Maharaja Hari Singh of J&K State as Ruler of J&K in the exercise of his sovereignty in and over the State executed the Instrument of Accession and acceded to the Dominion of India. The accession was signed and completed on 27th Oct. 1947 when Lord Mountbatten as Governor General of India accepted and signed in lieu thereof. Every Nation, State, Organisation or any entity whether individual or corporate has a day when it has come into existence. Individuals have birthdays while as corporate have date of incorporation. States have a state day. Nations have a day like we have 15th August or any other day for any nation. Other states have also a state day. But unfortunately J&K does not have any day which can be recognised as a State Day officially. In 1947, the Indian Independence Act, provided that as from the 15th August, 1947, there shall be set up an Independent Dominion known as India, and that the Government of India Act 1935 shall, with such omission, additions, adaptations and modifications as the governor-general may by order specify, be applicable to the Dominion of India. The British gave up their suzerainty of the states and left each of them free to choose whether to join one of the newly independent countries of India and Pakistan or to remain outside them. For a short time, some of the rulers explored the possibility of a federation of the states separate from either, but this came to nothing. Most of the states then decided to accede to India or to Pakistan. Government of India Act 1935 also provides that an Indian State may accede to the Dominion of India by an Instrument of Accession executed by the Ruler thereof. Maharaja Hari Singh of J&K State as Ruler of J&K in the exercise of his sovereignty in and over the State executed the Instrument of Accession and acceded to the Dominion of India. The accession to India can be celebrated as State Day annually on October 26 or October 27, as the day marks the date of existence. I don't see any objection from any quarter in declaring the 27th October as a state day as there is no other day as pious as 27th. The J&K state exists as a state because of 27th October when the accession was signed by ruler of J&K. It was on 26th October 1947 when Maharaja Shri Hari Singh, the then Ruler of J&K State, in the exercise of his Sovereignty in and over the State, executed the Instrument of Accession under the provisions of the Indian Independence Act 1947, and agreed to accede to the Dominion of India and the same was accepted by Governor General of India Mountbatten on 27th Oct. 1947. So J&K became legally and constitutionally part of India like other states of the country. The accession of J&K with the domain of India is final and irrevocable and it is high time for all the political parties to have Conesus on this issue as all the mainstream politicians and their parties who have been contesting the elections under the constitution should not have any objection to declare the holiday on 27th October as a J&K State Day. It is appealed to all the political parties to rise above their party politics and call a special session of assembly for declaring 27th October, accession day as a "State Day". Kashmir Issue, as it is being referred by selfish politicians for their vested interests who consider it as a territorial conflict primarily between India and Pakistan, having started just after the partition of India in 1947, was never as it. It was wrongly projected by the leaders of Kashmir. The root of conflict of so called Kashmir problem is that the Kashmiri Separatists and insurgents still have the hangover of the two nation theory of whom the Pakistan was born. The local leaders particularly Sheikhs wants to have their own share and exploited the masses in the name of religion and prepared them for revolt against India as Hindu Majority area. If these leaders had chosen to be part of Pakistan which they did not opt initially, fearing that they will be wiped out and by now they would not have been known, where as with the rest of India they are enjoying the best. The fact of the matter is that there is no such as Kashmir problem as has been wrongly projected by the leaders of Kashmir as well as paid and selected media but there is problem with a section of Muslim Sunni population in Kashmir who are still living under the hangover of two nation theory which divided people on religion lines. Obviously who chose to be part of Pakistan stayed in Pakistan or migrated to Pakistan which they got after partition but these people of Kashmir who raise some bogey of so called independence or merger with Pakistan, still craves in their dreams not for some economic or political reasons but simply for religion lines. Had there been no illusion to sheikh Abdullah, there would have been no Kashmir issue as such at present. By the year 1953 Sheikh with a changed mind, was a different person with the dream of Independence and sometimes pro-Pakistan attitude, Abdullah fell out with the Indian government. He was dismissed and imprisoned in August 1953. His former deputy, Bakshi Ghulam Mohammad was appointed in his place as the prime minister. He is not recognised in the entire state and even his mausoleum in Srinagar is heavily guarded despite some unsuccessful attempts were made to exhume from grave. He does not represent the state where as the 27th October applies to each and every person and party functioning in India and if at all there is resentment, it is from anti national elements and pro-Pak agents like separatists and there supporters with in mainstream politicians who play a dual game. Declaring 27th Oct. as State Holiday, will be a great tribute to the martyrs who have sacrificed their lives for the protection of life and honour of the people of J&K from tribal's who invaded the J&K, with the support of Pakistani regular army. I don't see any objection to any political party irrespective of their ideology and such a decision will give a befitting reply to those who challenge the accession of J&K with India. It will be also a litmus test for the government to prove whether they stand by the constitution of India or with the Hurriyat who are against the accession of J&K with Rest of India and will also silence those who one hand enjoys the power with the Govt. at their convenience and at the same time challenge the accession of J&K with India. |
