Six years on no action taken with regarding to 'illegal' leasing of property at Residency Road in Srinagar | Property worth 50 crores worth grossly undervalued | | Jehangir Rashid
Early Times Report SRINAGAR, Nov 8: For the past six years or so a report pertaining to the illegal leasing of property in a commercially important area of Srinagar city has not been implemented on the ground. The non-implementation of the report has resulted into a situation where-in the property is being eyed by some of the 'greedy' persons of the society. The property is valued more than 50 crores and given the lackadaisical attitude of the people at helm one cannot rule sabotage in this regard in the future as well. On 18-7-2012 then Additional Deputy Commissioner (ADC) Srinagar submitted a report to the office of Divisional Commissioner, Kashmir with respect to leasing of more than three kanals of land on the Residency Road by a person who was not authorized to do so. The ADC was asked to probe the matter following allegations by some of the shopkeepers of Fairdeal Shopping Complex located on the busy Residency Road that property has been leased out by an unauthorized person. The allegations were found out to be true and it was expected that matter would be settled but that was not to be. "Scrutiny of the documents produced on spot reveals that though there was no subsisting lease in favour of Bakshi Saleem in the year 2005, as the lease for the share expired in 2002, yet he alienated about 10 marlas of Nazool land, through an instrument of Rent deed executed in June 2006 and registered in the office of Sub Registrar Srinagar on 10th July 2006 in favour of one Wajahat Hassan Mir S/o. Ghulam Hassan Mir R/o. Pandrathan Srinagar," wrote the ADC in the report. The report further reads, "Bakshi Saleem applied under J&K State Land (vesting of ownership to occupants) Act 2004/2007 and got ownership rights for an area of 3 Kanals 3 Marlas and 264 Sft which was previously leased to him, this area obviously falls on the other side of the Fairdeal Complex. However, without any Shajrakat and contrary to the position obtaining on the spot the land under application was indicated on the State Bank of India side which has aggrieved the applicants herein to challenge the credence thereof." He got the said area mutated in his name under mutation number 475 of 2010 and then simultaneously sold the same through his nominated attorney, Farooq Ahmad Khan at a grossly undervalued price and got the mutation entered into and attested under mutation number 486 of 2010 intentionally depicting the area of late Bakshi Bashir as that of Bakshi Saleem to deprive the possessory shopkeepers of their entitlement to seek ownership rights of ex-lessee Bakshi Bashir's lease land, besides grabbing the land which he was not entitled to, reads the report. The fraud established in the report should have helped the administration to file a criminal case against the fraudster but that was not to be. He managed to run away without any harm and as on date there is lot of confusion as what is the real status of the whole case. The total land in question in the case is six kanals and seven Marlas. |
