HC suspends sentence, punishment in rape appeal; grants bail to convict | | | Early Times Report JAMMU, Nov 18: Justice Sanjay Kumar Gupta of J&K High Court suspended a sentence/ punishment passed by Sessions Judge Reasi. The Sessions Judge Reasi had sentenced 10 years imprisonment to Ranjeet Singh of Katra and awarded fine too. A.K. Sawhney Advocate challenged the conviction order of S R Gandhi Sessions Judge Reasi in the High Court at Jammu. He argued that the Sessions Judge's order is perverse and based on no facts and court did not appreciate the version of victim and her mother. Victim girl has stated in her examination in chief that she don't know the accused who was present in the court and likewise her mother too did not identified the accused. Both were declared hostile by the prosecution and cross examination by the prosecution. Another eye witness a friend of victim too declared hostile by the prosecution and cross examined the eye witness. Sawhney criticized the conviction judgment and vehemently argued that statements recorded by Police can't be basis for conviction. It is non application of mind, non appreciation of evidence, argued Sawhney. The High Court granted bail of Rs. 50,000 surety bond and Rs. 50,000 of personal bond, to the accused. |
