| Court awards 10 years rigorous imprisonment in case involving rape with minor | | | Early Times Report
JAMMU, Dec 12: 3rd Additional Sessions Judge Jammu Haq Nawaz Zargar today awarded 10 years rigorous imprisonment and imposed fine of Rs 20,000 on Jamna Dass who committed rape with a eight years old minor girl. The court also awarded compensation of Rs 3 lacs to victim.
The judge after hearing APP Sulekha Bhat for the state and Advocate G S Charak for the accused observed that reformation of a criminal shall be the primary goal of administration of criminal justice. In view of the aforesaid and also keeping in view the age of convict, ends of justice would be meted out, in case convict namely Jamna Dass is sentenced to undergo rigorous imprisonment for ten years and to pay fine of Rs 20000/- for the commission of offence under section 376 RPC.
According to the police case that as is alleged by the prosecution is that on 19-9-2014 at about 2.30 p.m, the accused had intercepted the way of victim (name withheld), aged eight years, when she was going to her home after getting curd from the shop and forcibly took her into a vacant plot having bushes with the intention to commit rape upon her. Accused undressed the victim and put of his own trouser and had given teeth bite on the chest of the victim. When the victim raised hue and cry, complainant along with her husband heard the screams of the victim, went towards the spot. They saw victim in naked condition and the accused was attempting to commit rape with her. Thereafter other people also came on the spot. Thereafter, accused laid down the victim and committed rape upon her. The accused had also put his male organ into the mouth victim. On the basis of this, FIR No. 77/2014 was registered. |
