SMC ward officer pays no heed to demolition orders issued by superior, allows construction of illegal structure | It is all mess at the civic body of summer capital of JK | | Jehangir Rashid

SRINAGAR, Dec 21: Despite the claims that stern action would be taken against the violators of law many officials of Srinagar Municipal Corporation (SMC) are 'hand in glove' with the people who raise structures without legal permission. Chief Enforcement Officer, SMC has shot off two letters to Enforcement Officer South asking the official to carry out demolition of a structure that has come up without the necessary permission in the Firdousabad locality of Batmaloo area in the summer capital of the state. Instead of taking action against the violators of law the Enforcement Officer, South of SMC is giving undue advantage to the persons who have carried out construction of illegal structure. The violators of law are so 'emboldened' that they did not respond to the show cause notice issued by Chief Enforcement Officer, SMC. Some of the locals of Firdousabad-Batmaloo moved an application with Chief Enforcement Officer, SMC on 27-9-2018 stating that two persons namely Shabir Ahmad Bhat and Sajad Ahmad Wani are carrying out illegal construction in the lane number four of Firdousabad area. The complainants said that although the construction has been stayed by a local court the violators are going on with the construction. Following this Chief Enforcement Officer, SMC shot a correspondence to Enforcement Officer South, SMC asking him to carry out demolition on October 6, 2018. The Enforcement Officer, South was asked to carry out demolition and submit the action taken report to the office of Chief Enforcement Officer, SMC. "In connection with the above, the date of demolition for demolition of illegal/un-authorized construction has been fixed on 06-10-2018 at 11:00 AM. In this connection you will please proceed further for demolition on scheduled date and time and submit action taken report," wrote Chief Enforcement Officer, SMC under correspondence number SMC/ENF/14511-18 dated 27-09-2018. The demolition of illegal structure did not take place with the violators constructing one storey building. The locals alleged that the local ward officer assured the violators that their structure would not be touched but for the same they would have pay to hefty amount. For a long period of time no action took place and in fact the ward officer abused the wife of one of the complainants on phone. On November 27, 2018 a show cause notice was issued to the violators by Chief Enforcement Officer, SMC and they were asked to respond to the notice within 48 hours. As the violators of law did not respond to the show cause notice the Chief Enforcement Officer, SMC issued yet another show cause notice on November 30, 2018. In the latest show cause notice the violators were asked to respond within seven days, but yet again there was no response from the other side. Following this the Chief Enforcement Officer, SMC issued fresh demolition order and this time around the demolition was fixed on 13-12-2018. "In connection with the above the date of demolition for demolition of illegal/un-authorized construction has been fixed on 13-12-2018 at 3:00 P.M. In this connection you will please proceed further for demolition purpose on scheduled date and time and submit action taken report," wrote Chief Enforcement Officer, SMC to Enforcement Officer, SMC Central/South under correspondence number SMC/ENF/20999-21006 dated 11-12-2018. Although a week has passed since the issuance of latest demolition order no action whatsoever has been taken with the complainants pointing fingers towards the role of ward officer in the whole affair. |
