State Tax Deptt issues notices worth Rs 3.33 cr to defaulters
Rs 60.50 lakh tax, penalty realized during intensified drive

JAMMU, JANUARY 08: The State Taxes Department, J&K has issued notices to various business houses for depositing tax penalties under GST.

According to a spokesman of the State Taxes Department, the notices have been issued as a part of the intensified drive launched by the Department on the directions of Commissioner, State Taxes, PK Bhat to ensure tax compliance and non-evasion of GST revenue.

Giving details, the spokesman said that notice under Section-74 of the JKSGST Act has been issued to Addison Resort (Punjabi Haveli) National Highway, Suketar, for depositing tax and penalty of Rs 27,04,853. “Proceedingswere initiated as the business establishment has failed to deposit the amount after it was noticed that it had willfully short-paid the tax for the period from July, 2017 to March, 2018,” he said.

Meanwhile, the State Taxes Department, Jammu also inspected Neeru Hardware at Bhaderwah and detected huge tax evasion worth Rs 39 lacs. “As per the sale records seized from the business establishment, the total sales from July 2017 to December 2018 were approximately of Rs 2.29 crores,” he said and added that the business establishment has not complied with the GST provisions and notice under Section 76 has been issued for depositing the tax amount and penalty worth Rs 39 lacs thereof.

He said the State Tax Department has also started confiscation proceedings of vehicle No: JK02AP-8660 alongwith the textile/made-up items which were seized/detained during a routine check at Jammu. “Confiscation proceedings have been initiated in view of failure of the owner of the vehicle and the commodities in depositing the tax amount and the penalty as provided under the GST law,” he said and added that as per the proceedings initiated, the owner has been directed to deposit an amount of Rs 12,24,000/- in lieu of confiscation.

The spokesman said that the State Taxes Department has also issued notice under Section 76 to IBK Foods and Hospitalities Private Limited (Smokin Joes) demanding deposition of an amount of Rs18,44,440 for not complying with the provisions of the GST law from July 2017 till date. “Meanwhile, another notice under Section 76 has been issued by the State Tax Department to Vardaan Security and Facilitation Private Limited under Section 76 of the J&K SGST Act calling for deposition of an amount of Rs 37,04,818for not complying with the provisions of the GST Law from July 2017 to March 2018,” he said.

The spokesman said that on specific information the State Taxes Department, Jammu inspected a godown belonging to Hari Enterprises at Channi Himmat, Jammu. “On inspection it was found that the godown was not registered under relevant provisions of the law and undeclared commodities worth Rs 13 lacs were found available at site,” he said and added that proceedings under relevant provision of law have been initiated for deposition of tax and penalty by the concerned.

“On the basis of specific input, the State Taxes Department, Jammu detained a vehicle bearing Registration No: JK03C-7411 carrying and transporting goods on behalf of PV Chandra Trading Agency. During physical check of the vehicle it was found that the vehicle was carrying 28,038 meters of textile whereas same was declared as 15,662 meters only in the invoice. Acting as per the provisions of the GST law, a tax and penalty of Rs 2,22,168 was recovered from the erring dealer on spot,” he said and added that the Tax Department also realised Rs 4,41,000 from the casual blanket sellers who were inspected by the department few days back. “Blanket sellers have now applied for registration under Casual Scheme of GST Law,” he said.

He said the State Taxes Department, Udhampur on the basis of specific input detained vehicle bearing Registration No: JK05C-5027 and put it to physical check. “An amount of Rs 6,12, 044 was recovered from the owner for transporting textiles which were grossly undervalued for evasion of tax,” he said.

At Kathua, he said, the State Taxes Department on specific input inspected 2 vehicles bearing Registration Nos. JK05B-0477 & JK01J-2032. The vehicles were put to physical check by the State Taxes Department. Tax and penalty amounted of Rs 10 lacs approximately was recovered from the erring dealer on spot for indulging in gross violation under declaration of the value of the commodities being transported.

In another case, the State Tax Department, Jammu recovered an amount of Rs 5,88,000from the transporter of the goods for under and wrong declaration of goods as the owner of the goods does not came forward. “The goods seized were high value copper scrap attracting tax rate of 18%,” he said.

The State Taxes Officers of Jammu Circles, on the basis of specific input seized jackets worth Rs 6,75,250at Teli Basti Bari-Brahmana and proceedings under relevant provisions of the GST law are being initiated against the seller. “The information received by the department was that high value jackets are being sold in causal manner without adhering the GST law and thus causing huge loss to the State exchequer and also causing loss of genuine traders,” he said.

The spokesman said that the Kashmir Tyres, Narwal, Jammu inspected some days back by the State Taxes Department, Jammu who was found conducting business activities without having proper registration, has deposited an amount of Rs 8 lacs as tax and penalty. Business establishment has now got registered under the GST law.

M/s Gogi Motors, Narwal, Jammu who was also inspected by the State Taxes Department, Jammu has deposited an amount of Rs. 20 lacs as tax. M/s KN Enterprises, Narwal, Jammu has deposited an amount of Rs. 3.50 lacs as tax and penalty on undeclared items found during inspection of his premises.

The State Taxes Department, Jammu has also issued notice under Section 74 to M/s JagdambaTyre House for deposition of tax and penalty amounting of Rs 2 crores 14 lacs. The concerned business establishment was found having an undeclared turnover of Rs. 3 crores 85 lacs from April, 2018 to October, 2018.

He said the team of State Tax Officers who conducted the inspections include Mr. Mohit Raina, Mohammad Riyaz, Neeraj Sharma, Arvind Sawhney, Abdul Rehman, Anissa Nabi, Ajit Kumar, Kuldip Jandial, Javed Iqbal, Saba Noor, Ramneek Singh and Inspectors of the Department.
