Terminated for gross misconduct, official reinstated arbitrarily | Rules for fools! | | Early Times Report JAMMU, Jan 13: An official engaged under Central Sponsored Scheme of Health and Medical Education Department who was terminated for unauthorised absence from duty has been reinstated arbitrarily, indicating that rules were framed only for fools. Reliable sources from department concerned informed ET that the State Accounts Manager engaged under National Health Mission had absented himself from his duties at Divisional Office NHM Kashmir without intimating his senior officers from May 17, 2018. "Two notices vide No. SHS/NHM/J&K/7442-44 Dated: 23-05-2018 and No. SHS/NHM/J&K/FMG/K/1292-94 Dated: 23-05-2018 were served to said officer to join his duties within three days and explain his position", sources said, but the said officer preferred to remain absent from duty confining all office records, equipment and codes/passwords of PFMS/DBT, thus hampering the functioning of the office (PFMS/DBT etc). Several telephonic calls were made to the said officer by senior officers from Administrative Department and National Health Mission in connection with urgent official work but he did not respond to the calls. A public notice on June 13, 2018, was issued through Print Media, whereby a final opportunity was given to the officer to resume his duties at Divisional Office NHM, Kashmir within five days from the date of publication of notice, but he failed to report, even after the expiry of time afforded to him. "Another notice vide No. SHS/NHM/J&K/10846 Dated: 29-06-2018 was issued in Print Media directing the officer to handover office equipment, official records, codes/passwords of PFMS and DBT withheld by the said officer to FA&VSO, NHM, J&K in the absence of which payments under various programmes were pending, thereby hampering overall functioning of the office, within two days from the publication of the notice", sources said, adding that in view of afore mentioned events, the matter was referred to Additional, Advocate General J&K High Court at Srinagar for legal opinion with regard to future course of action, who suggested for immediate termination of the officer keeping in view the loss suffered by the department due to his unauthorised absence. Sources further said that serious notice was taken by the administrative department, and his termination was ordered vide order No.. 95 of 2018 Dated:06-07-2018 and a copy of the termination letter was forwarded to Principal Secretary to Government Health and Medical Education Department but astoundingly after transfer of the then Mission Director NHM, the new officer threw rules into bin and reinstated the irresponsible officer at the same post. Repeated calls to NHM, Mission Director, Bhupinder Kumar evoked no response. |
