HC directs quick disposal of pending land acquisition cases | | | Early Times Report Srinagar, Feb 12: The state High Court has directed authorities to seek expeditious disposal of the cases related to land acquisition coming in way of road widening of Dalgate to Hazratbal Srinagar. A division bench of the court passed the orders after a Deputy Commissioner Srinaga submitted that there are several cases pending before the courts, a majority of them relate to the amount of compensation. In few cases, he said, there are disputes which inter-se the owners, family disputes, partnership disputes pending before the courts. In other cases, he said there are orders of status quo. "The official respondents shall move appropriate application(s) seeking expedient disposal of all these cases so as to ensure that process of acquisition is expeditiously completed and the project of road widening is not delayed any further." On previous date of hearing, the court directed Chief Engineer, PWD (R&B) Kashmir to set-out the dates with time lines with regard to all the matters including approval of the proposal of road widening from Dalgate to Hazratbal Srinagar. Hearing a petition, complaining unwarranted delay in road widening from Dalgate to Hazratbal, court had observed: "We have perused the status report filed by the Chief Engineer, PWD (R&B) Kashmir, in the matter. The same is hopelessly deficient and gives no dates as well." The Chief Engineer in the status report referred to lack of funds for the initiation of acquisition process. Taking note of it, the court had directed the Deputy Commissioner Srinagar, who is land acquiring authority, to give specific details of the steps taken for acquisition, release of compensation and taking-over of possession of the required land as well as the status of the fund availability towards compensation which is payable. |
