Court acquits accused for offences under Arms Act | | | Early Times Report
Jammu, Feb 26: Railway Magistrate Jammu Yahaya Firdous acquitted all the accused persons who were facing trial since 2015 for offences under section 325,341,323201,147 R.PC and 4/25 Arms Act. Adv Priyanshu Sharma Counsel for the accused submitted before the court that there is civil suit going on between the accused persons as well as the complainant and this complaint is the outcome of that suit only and furthermore, no independent witness has been arrayed as prosecution witness even after their presence was recorded in the challan and in the statement. Moreover Adv. Priyanshu Sharma submitted that weapon of offence has been changed during cheif and cross examination of the Prosecution witnesses and as such proseuction had failed to prove the weapon of offence as seized by the police. Court after hearing the counsel and while appreciating the evidences held that material contradiction have been recorded among the prosecution witnesses, the prosecution failed to demonstrate and explain the spot of occurrence. Thus the accused persons cannot be held guilty under such circumstances where the prosecution failed to prove their case beyond shadow of doubt, as such accused are acquitted. |
