Future at stake, dental surgeons hanging in fire

The future of the BDS
and MDS dental Surgeons is very much at stake in the state of Jammu and Kashmir as during the last one decade, their absorption on the regular posts in the medical department is zero resulting which their lives are hanging in fire. It has been learnt from the media that their number is more than 3000+. The state political governments in the past had adopted a very strange approach in dealing with the issues of the doctors particularly of the dental lines who were doing their jobs sincerely with dedication in serving the people of this backward state without any monetary benefits. Same is the case during the President's Rule also. They are the worst sufferers of the inactions of the State Administration on this score. It is a set case for initiating a PROBE into this serious matter as to why these posts were not advertised during the last one decade? It is the total lethargy on the part of the Heath and Medical Education Department of the state which needs immediate attention of His Excellency the Governor of the state. As per the news item published in this esteemed paper on March 6, the delegation of the Dental Surgeons told the Early Times that the State Government remained as a failure to advertise the posts for the Dental Surgeons in the state and has severely criticized the H &ME Department on this score and pointed out that the last appointments were made in the year 2008 only and after that no appointment has been made and in fact the said department is deeply sleeping over the matter and playing with the precious lives of these doctors. On the contrary, more than 3000 dental graduates and post graduates degree holders are awaiting for their appointments on the regular posts. It is learnt that huge vacancies are there for the Dental Surgeons in the state but not filling them properly, the Dental Hospitals and Colleges are not meeting with the dire needs of the patients across the state effectively resulting which the poor patients are spending huge amounts over their dental ailments in the private clinics after covering the large distances in this backward state of the Indian Union. Two major issues are there at the moment:-
1. Absorption of BDS and MDS Doctors on the regular Govt. posts in the Government Hospitals in the state and
2. Non payment of any stipend to the Dental doctors who have done degrees from outside the state which is discriminatory in nature as per their fundamental right as per the Indian Constitution.
1. Absorption of BDS and MDS Doctors on the regular Govt. posts in the Government Hospitals
Time and again in the past the print media of the state have brought this fact before the then political sets up of the state as also the Governor's Rule followed by the present President's Rule but all in vain. It is the demand of the hour that the issue involved be settled at the earliest possible otherwise these doctors would be compelled to come on the streets of the state for seeking the justice at the end of the Governor Satya Pal Malik. It seems that the issues of the public importance are not placed in the right earnest by the state administration before the His Excellency. For how long these doctors would have to suffer more? Due to their non absorption in the State Government services for years together, they are loosing their marital value day by day. It is very painful indeed. The concerned authorities be directed to clear the backlog of more than 3000 BDS and MDS doctors in the state by advertising the posts as early as possible. It is also mentioned that since one decade or so none of the BDS and MDS doctors stand adjusted in the governmental services in the state as yet. This means that the State Government is playing with their precious lives without any fault of theirs. Due to their non absorption into the government service, they are feeling helpless and burden upon their parents. Their future is very much at stake. It becomes obligatory on the part of the State Government to come at their rescue immediately without any further loss of time.
Needless to mention here that the professionally trained incumbents in the fields of Education, Agriculture, MBBS doctors, Power, PHE, RDD, Secretariat services, KAS have been recruited by the State Government in large numbers but on the contrary the unlucky lot of the Dental Surgeons have been left out totally at the mercy of the God.
2. Non payment of any stipend to the Dental doctors who have done degrees from outside the state which is discriminatory in nature as per their fundamental right as per the Indian Constitution
The instant issue involved is of discriminatory in nature which needs the immediate attention of the State Administration which is presently under the President's Rule for clinching the issue at the earliest. The BDS doctors are treated with two different yardsticks - One bunch of BDS doctors are getting the Stipend @ Rs.20000 PM from the State Government regularly whereas the other bunch of BDS doctors are not getting the same. This should not happen in our state when everybody is equal before the law of the land. Boys and Girls of the soil usually go for the higher studies outside the state of Jammu and Kashmir and by putting in their hard work, time, energy and mental stress to get their degrees in the fields of Medical, Dental, Engineering, IIT, MBA, IIM etc.etc. after 2-6 years (depending on the field or stream) Here, I am projecting the dental profession just for the sake of the argument as an illustration. It looks funny that a Doctor in the Dentistry line after getting the degree is under obligation to go for the Rotatory Internship for one year or so ( without any stipend ) and after doing the same when they are given the assignment as the house Job in any Govt. Dental College and Hospital, these Doctors, who have done their degrees from outside the state, they do not get any stipend or honourarium and whereas the Doctors who, have done their degrees from within the state, they get the stipend amounting to Rupees 20000 per month from the college in which they are doing their house jobs as there is no bar on them ( no stipend ). They get their remunerations along with the other staff of the college every month. To be on the safer side administratively, the College Management do take the Affidavits duly attested by the Magistrates from the Doctors, who have done their degrees from outside the state for not claiming any stipend or remuneration from the college during the period of their house jobs in the College. This is very pinching and painful indeed because of the fact that it is a clear cut case of the discriminatory treatment to the doctors who obtained their degrees from outside the state.
It should not be the approach of the State Government to deal with them administratively as an biased authority. I am bringing it to the kind knowledge of the readers that the State Government is not doing the justice in according with the principles of the administration of the natural justice on this score. Majority of these doctors are from the middle and poor strata families and are suffering more in these hard days. Not only this, it is very important to mention here that before the law of the land, all are equal as per the fundamental rights as enshrined in the Indian Constitution. Then, why this disparity in not treating them equally ? The case of these doctors was brought into the notice of the Governor's administration on August 25 last year and with the request for clinching the issue of the Doctors ( Dental) who are doing the house jobs in different Govt. Dental Colleges and Hospitals in the state should be treated as one lot only ( who have done the BDS within or outside the state ) in accordance with the principle of administration of the natural justice but all in vain.
Pertinent to point out here that two categories of Dental doctors (their Dental Colleges treat them) are there:-
1. Candidates who went outside the state for doing BDS on their own expenses as their family financial position was very good and others whose financial was not so good they went outside the state for doing the BDS after having borrowed the educational loans from the banks. Since they have not yet got the regular appointments because of which they are not in a position to liquidate the educational loans and the lending banks are pressurizing them for the repayment of loan installments every month regularly.
2. Candidates who did BDS in the state
In the instant case, it is painful in stating that the candidates who did BDS in the state are getting the stipend of Rs.20000 every month out of the exchequer of the State Government and whereas the candidates who did BDS from outside the state are not being paid by the State Government which is very unfortunate. The State Administration under the President's Rule should invite the applicatios for the posts of the Dental Surgeons in the state immediately and their adjustments are made in a time bound manner and the State should start paying the Stipend @ Rs , 20000 per month to the Dental Surgeons effecting from March last year at least who are doing their House jobs after doing the BDS degrees from outside the state as is being done in the case of the Dental Surgeons having the BDS degrees from the state .
The wrong and mindless approach adopted by the past political governments in the state of Jammu and Kashmir was really deplorable.
It is worth mentioning here with the imposition of the Governor's Rule in the state on June 20 last year in the state followed by the President's Rule, the things started moving in a very fast manner and the people of the state got the sigh of relief in getting the real returns from the Governor's Administration. It is expected much that the same tempo may be made in dealing with administrative issues promptly in future also. The Dental Surgeons whose future is stake may get the justice at the august hands of His Excellency the Governor Satya Pal Malik without any further delay, it is expected.
